The purpose of this project is to relocate a 305 liner foot section of the historicall y piped w ate rway . For the most part the realigned system can be constructed "in the dry" adjacent to the existing piped system. However, when the t wo ends of the realigned pipe system are tied into the e xisting system , the City plans to install temporary fills as part of the de watering system. This work is shown on the enclosed plan drawings entitled "DRAINAGE RELOCATION PROJECT, CITY OF NORTHAMPTON , MASSACHUSETTS ," on a total of four sheets and dated "01-21-2017 " as well as "NORTHAMPTON DRAINAGE RELOCATION, NORTHAMPTON LUMBER YARD , PLEASANT STREET, NORTHAMPTON , MA," on a total of three sheets (Sheets C-3 , C-4 , and C-5), and dated "03/01/2017 ", Based on the information you have provided , we have determined that the proposed acti vity, which includes w ork and/or a discharge of dredged or fill material into w aters of the United States w ill have onl y minimal indi vidual or cumulati ve environmental impacts . Therefore, this work is authorized under the enclosed February 2015 General Permits for Massachusetts (GP MA), specificall y GP #9 , as a self-verification activity. This work must be performed in accordance with the, terms and conditions of the GP and also in compliance with the follo wing special conditions: 1. You must complete and return the enclosed Work Start Notification Form to this office prior to the start of the authorized work. 2 . NOTE: General Condition #15 of the GP MA requires that all temporary fills are remo ved in their entirety post construction. You are responsible for complying with all of the GP requirements. Please review the enclosed GP MA document carefully, in particular the general conditions beginning on Page 23, to familiarize yourself with its contents. You should ensure that whoever does the work fully understands the requirements and that a copy of the permit document and this authorization letter are at the project site throughout the time the work is underway. Based upon coordination with the appropriate State and Federal resource agencies, the Corps has decided to waiver the typical in-water construction time-of-year restriction requirement for Market Street Brook (see GP MA General Condition # 18). This authorization does not obviate the need to obtain other Federal, state, or local authorizations required by law, as listed on Page 57 of the GP document. Performing work not specifically authorized by this determination or failing to comply with any special conditions provided above or all the terms and conditions of the GP may subject you to the enforcement provisions of our regulations. This authorization presumes that the work as described above and as shown on your plans noted above is in waters of the U.S. You may submit a request for an approved jurisdictional determination to this office in writing if you desire. This authorization expires on February 4, 2020. You must commence or have under contract to commence the work authorized herein by February 4, 2020 and complete the work by February 4, 2021. If you do not , you must contact this office to determine the need for further authorization before beginning or continuing the activity. We recommend you contact us before this permit expires to discuss a time extension or permit reissuance. You must contact us immediately to discuss modification of this authorization if you change the plans or construction methods for work within our jurisdiction.
