Second Amendment to Contract #320-17-2: Northampton Drain Relocation
THIS AGREEMENT, executed this __________ day of October 2017 by and between the City of
Northampton, a Massachusetts municipal corporation, acting through its Office of Planning and
Sustainability with a mailing address of Wayne Feiden, Director of Planning and Sustainability, 210 Main
Street, Room 11, Northampton, MA 01060, hereinafter called "Owner" and George Cairns and Sons,
Inc., with a mailing address of 8 Ledge Road, Windham, NH, 03087, party of the second part hereinafter
called "Vendor".
Whereas the City and George Cairns and Sons signed:
Contract #320-17 ($1,797,962) for the relocation of the Market Street-Holyoke Street Drain; and
Amended Contract #320-17-1 (additional $3,697.50) to increase a related manhole size.
Now the contract is being amended, Contract #320-17-2, to remove a sanitary sewer discharge from the
Market Street-Holyoke Street Drain to ensure the project is in conformance with environmental and city
regulations.
The OWNER shall pay the Vendor for the performance of this contract amendment, based on time
and materials, in the sum not-to-exceed Sixty-One Thousand, Seven Hundred and Fifteen and
48/100 Dollars ($61,715.48) in accordance with the attached with the attached Sewer Pump Station
& Grinder Pricing Breakdown.
The deadline for the completion of the project shall be extended by 20 days.
All other terms of the original contract and first amendment remain in effect.
IN WITNESS WHEREOF the Vendor caused these presents to be signed in quadruplicate and approved
by David Narkewicz its Mayor and the said Owner has caused these presents to be signed in
quadruplicate and its official seal to be hereto affixed by its officer or agent thereunto duly authorized (by
the attached corporate resolution). This instrument shall take effect as a sealed instrument.
