CITY OF NORTHAMPTON, a municipal corporation with an address of 210 Main Street, Northampton, Massachusetts 01060,
In consideration of One ($1.00) Dollar, PAID
Grants to KOLLMORGEN CORPORATION, a New York corporation with a usual place of business at 50 Prince Street, Northampton, Massachusetts 01060,
An easement over and upon the Grantor’s property at 91 Grove Street to construct a berm and drainage swale/channel within the “Drainage System Maintenance Easement Area” (the “Easement
Area”) as shown on the sketch plan attached as Exhibit “A” and incorporated herein. The easement includes all rights for drainage over and upon the Easement Area and the right to enter
upon the Easement Area to maintain the berm and drainage swale/channel.
The Grantee accepts and covenants that they will have an affirmative obligation to maintain the berm and drainage swale/channel to prevent erosion and degradation and prevent water from
flooding the area southerly of the berm.
If the Grantor’s future development of the property at 91 Grove Street requires a relocation or reconfiguration of the Easement Area, the Grantee shall pay such costs as are required
to relocate or reconfigure the Easement Area.
Grantor’s title to 19 Grove Street is by deed from the Commonwealth of Massachusetts dated November 19, 1998, being Parcel 2 in said deed recorded in the Hampshire Registry of Deeds
in Book 5558 Page 19.
Pursuant to the Order of the Northampton City Council dated ___________ and attached as Exhibit “B”.
