The requested use protects adjoining premises against seriously detrimental uses. If applicable, this shall include provision for surface water drainage, sound and sight buffers and preservation of views, light, and air. Tree protection will be installed on the easterly edge to protect abutter’s trees. B. In order to meet the standard that the requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, the Board denied the 30’ wide curb opening noting that 15’ width would meet this standard. The project, including any concurrent road improvements, will not decrease the level of service (LOS) of all area City and state roads or intersections affected by the project below the existing conditions and the Board. The applicant as offered will make a one-time payment-in-lieu of the additional 1 peak hour trip generated by the site in the amount of $1,000. C. The site will function harmoniously in relation to other structures and open spaces to the natural landscape, existing buildings and other community assets in the area as it relates to landscaping, drainage, sight lines, building orientation, massing, egress, and setbacks. With a reduction in driveway width to the by-right width the siting will more closely fit in to the character of the neighborhood. D. The requested use will not overload, and will mitigate adverse impacts on the City's resources. The construction materials and methods for water lines, sanitary sewers, storm sewers, fire protection, sidewalks, private roads, and other infrastructure shall be those set forth in the Northampton Subdivision Regulations. The addition of one unit will not overload the existing infrastructure. E. The requested use meets any special regulations set forth in this chapter. See URC TABLE for layout standards within the URC zone. The structure is within the 20’ rear yard setback. However, the Zoning Board granted a Finding to allow the encroachment which is less than the existing conditions. The Board could not find that the applicant met the criteria in 350-8.8(H) for a wider than 15’ curb cut. F. Compliance with the following technical performance standards: (1) Curb cuts onto streets are minimized by creating only a 15’ wide curb opening. (2) Pedestrian, bicycle and vehicular traffic movement on site is separated, to the extent possible. CONDITIONS Prior to Any Site Disturbance 1. The applicant must submit to Office of Planning and Sustainability an arborist’s report on protection measures necessary to protect the Pine trees along the easterly property boundary. All protection measures must then be installed and inspected by staff prior to site work. 2. The applicant shall obtain approval for any work planned around or including the public shade tree on Kingsley Avenue. Prior to Issuance of a Building Permit Prior to Issuance of a Certificate of Occupancy 3. Plans must be submitted to the Office of Planning & Sustainability showing a new structure with driveway location with a maximum of 15’ width. . 4.
