Thanks for sending this along. I can certainly appreciate her concerns. Especially since someone attempted to sue them in the past. I can imagine that was very stressful. I would be happy to address the issue with some signage that says private property do not enter, and I would be more than happy to make sure it’s written very clearly in the lease that it would be a violation of the lease to enter her property. I believe the likelihood that any tenant would be interested in crossing that property is zero. There’s nothing attractive to get to by going through that property, in addition the brambles and brush and shrubbery make it very uninviting to walk in. Most likely if a tenant has a child they will want to access Jackson Street playground out the front. The other things people are most interested in getting to are best accessed out the front of the property. Especially since the rail trail entrance is so close on the street if tenants are moving on foot or bike they will want to use the paved sidewalk. There’s already a 6’ chain-link fence bordering two sides of the property with Hathaway Farms apartment complex. Therefore I believe it would be more aesthetically pleasing to have the natural trees and shrubbery create that third border. Is there any regulation that states that I have to put up a fence? I have owned property there and rented the two existing units to a variety of tenants over the past seven years and do not believe any tenant has ever crossed her property. Addressing her concern about water I believe Terry has done an excellent job planning for this with the dry wells, the porous pavement, and long swale on the north side. In addition this property has an elevation drop from the south side, the border with Ms. Boucher’s, towards the north side with the swale. In terms of traffic I know that the added small apartments are going to add a little additional traffic to the area. It’s my understanding that very large apartment complexes and businesses like Walmart have a much bigger impact on traffic than five small residential units. As I understand this is being addressed with the $5000 fee to the city. I will be responding, but you should be prepared to answer these questions. I spoke with Ms Boucher on the phone last week and she mentioned the interest in having a fence to prevent people from cutting across her property. Though I do not think a chain link fence is the right aesthetic choice and the Board would probably accept something more in residential character, you should discuss with your client a means to address this concern raised by the neighbor. I am most interested in this project as I directly border this project at 159 Jackson St. I do have some concerns and have listed them below: 1. Was a traffic study done for this project? I am concerned about the extra traffic spilling onto Jackson St. as the street is already congested and there are some safety concerns with the school nearby. 2. Where will the excess water be directed? When Hampton Gardens was built the excess water was directed to the back of my land and now I have excess water there. 3. Will there be a chain link fence to separate the properties? I am concerned that residents will come on my property and potentially injure themsleves. Years ago my husband and I were sued from a Hampton Gardens resident who trespassed on our property and was injured. They later determined that the resident was not on our property so the lawsuit was dismissed, but the stress of the incident took a lasting toll on us. Lastly, if for some reason I am not able to dial into the session on 4/23. How would my concerns be addressed and how would I be notified of the results or answers to these concerns?
