Use Group S-1 of the Hazard Index per Table 2204, Hazard Index 3.
This building is part of another building which houses the Adolescent Day
Treatment Center, which is Business Use Group B, Hazard Index 2.
The construction of the east wall of the garage is wood frame. The other walls
are masonry. We believe the construction classification, therefore, would be
Type 4C.
In accordance with Section 2204.2 and 2204.9, we are providing a sprinkler
system and we will not extend the fire walls above the roof height.
I believe the plans comply with the State Building Code. Please advise if you
have any questions.

DECISION OF
ZONING BOARD OF APPEALS
At a meeting held on:Xay 22, 19851 the Zoning Board of Appeals of
the City of Northampton voted unanimously to grant two Special Permit
requests of John Kuzeja, Jr. and Andrea Nelson, d/b/a ARC Garage,
ce Road, Williamsburg, MA to relocated their automotive repair business
to 320 Riverside Drive, Northampton (GI and Watershed Overlay Protection
Zones). Present and voting were: Chairman Robert C. Buscher, William
Brandt and Peter Laband.
The findings for the Special Permit under the Watershed Overlay
Protection were as follows:
W. Brandt, R. Buscher and P. Laband found' that conditions had
been met and imposed the following restrictions recommended by the
Conservation Commission:
1. That vehicles which are damaged, dismantled, missing parts
or leaking fluids shall be stored inside of the building.
2. That suitable measures be taken to prevent pollutants and
fluids from leaving the building. The floor of the structure
shall be constructed in such a way that a spill of any toxic
waste would be contained within the building, subject to the
approval of the Conservation Commission. There shall be no
floor drain.
The findings for the Special Permit under the GI Zone were as
follows:
W. Brandt, referring to Section 10.10, found that the requested use
is listed in the Table of Use Regulations; that, although he had ambivalent
feelings, found that the requested use would bear a positive relationship
to the public convenience; that the requested use would not unduly impair
pedestrian safety or create undue traffic -congestion; that public utilities
would not be overburdened; and that the requested use would not impair the
1 integrity of the district.
R. Buscher found that the requested use is listed in the Table of Use
Regulations; that by testimony received, the ARC Garage appears to be a
repsectable and successful auto repair business and will bear a positive
relationship to the public convenience; that by imposing the restriction
requiring test driving on the sparsely populated section of Riverside Drive,
the requested use would not create any undue traffic or pedestrian safety;
that because the prior usage in the old structure, although somewhat noisy,
did not seem to bother the neighborhood, he found that the requested use
would not impair the integrity of the neighborhood if the business were
{� carried on within the four walls, during normal business hours and with
==1 minimum noise. He noted that any use would proliferate traffic and increase
the intensity of use in some way.
P. Laband found that all of the items in Section 10.10 have been satisfied
specifically that the requested use bears a positive relationship to the
public convenience and will not impair the integrity of the adjoining zone,
as the site is an ideal location for such a business, which is necessary
for all car owners.

1. That the applicants rent 1,783 sq. ft. of the space, more or less,
in a portion of the Cutlery Buildings located in such area of the
building as has previously been shown and agreed upon and as shown
on the architectural drawing submitted with the application.
2. That the applicants use no more than six (6) parking places, which
spaces will be physically designated in the parking area by CBA
and will be located where spaces 21-26 are shown on the plan of
Cutlery Buildings submitted with the application. All vehicles
associated with the ARC Garage shall be parked outside of the
Watershed Overlay District.
3. The ARC Garage shall not repair cars in the parking area or
advertise cars for "sale in the parking area.
4. That the ARC Garage shall be prohibited from operating any unmuffled
or improperly muffled cars or otherwise conducting their business
in a disruptive or noisy manner that unreasonably intrudes upon
1 other tenants or abutting neighbors. The applicants shall also be
required to have contractural arrangements for proper disposal of
waste oil products as required by all applicable laws or ordinances.
5. That the ARC Garage shall conduct all test driving of vehicles on
Riverside Drive proceeding north from the premises.
6. That the ARC Garage operate Monday through Friday from 7:00 a.m.
to 6:00 p.m. and Saturdays from 7:00 a.m. to 6:00 p.m. with no
Sunday hours.
7. That the permit be renewed after one year to ascertain that all
conditions have been complied with.
