Chapter 350. Zoning
§ 350-9.3. Change, extenion or alteration of legall preexiting nonconforming
tructure, ue, or lot.
Legall preexiting nonconforming tructure, ue, or lot ma e changed, extended or altered a et forth elow. If a ue i noteligile under one uection, proceed to the next uection.
A preexiting nonconforming tructure or ue ma e changed, extended or altered:
A-of-right if the expanion/change itelf meet all the dimenional and ue requirement of the current zoning.
A-of-right in a reidential ditrict, when aid change i from a preexiting nonconforming ue to a conforming reidentialue, and there are no change to the exterior of the tructure or lot and no new nonconformitie are created uchchange/converion.
A-of-right when aid change or alteration i limited to reuilding a ingle- or two-famil home detroed ère or othernatural diater within two ear of the diater. Recontruction mut either meet the current zoning requirement or fallwithin the ame footprint and height of the detroed home o a not to expand the nonconforming nature of aid home.
A-of-right when aid change or alteration i limited to reuilding an other uilding not more than 50% detroed èreor other natural diater when the change i limited to reuilding or replacing the tructure within the preexiting footprintand height of the exiting tructure or within an area and height that conform to all dimenional requirement and allcontruction occur within two ear of the diater.
A-of-right, if the expanion (vertical or horizontal) i for a reidential ue and doe not extend either further than ève feetinto a required etack or further than the exiting nonconforming tructure, whichever i le and uch extenion doenot create an new zoning violation (uch a further reducing a etack or open pace).

With a pecial permit for a ingle- or two-famil home when the Zoning oard make a ènding that the change whichinclude new zoning violation (uch a reduction of open pace, new etack encroachment or further encroachmentinto the etack, etc.) will not e utantiall more detrimental to the neighorhood than the exiting nonconformingingle- or two-famil tructure.
With a comination of a ènding and variance when applicale.
A conforming ue on a preexiting nonconforming lot: A conforming ue on uch a lot ma e changed, extended or altered:
A-of-right to the ame conforming ue in a conforming tructure, which meet all the dimenional, and denit proviionof the current zoning, except for lot ize, frontage, or depth and when the lot ize, frontage, and depth requirement donot change.
With a ènding from the Zoning oard of Appeal when aid change, extenion or alteration i to a diçerent conforming uewhich require the ame or le minimum lot area, minimum lot width and frontage, minimum lot depth, etack, andparking than i required for the preent ue (and lot doe not full conform to the preent zoning requirement for thepropoed ue).
With a variance to a conforming ue which require a larger minimum lot area, minimum lot width or frontage or minimumlot depth than i required for the preent ue or create an other new zoning violation.
With a comination of a ènding and variance when applicale.
A preexiting nonconforming lot ma e changed, extended or altered:
A-of-right if uch change, extenion or alteration to the lot doe not increae the nonconforming nature of the propert,onl ring the lot into total conformance with the zoning requirement in exitence at the time of aid change, extenionor alteration, or add to the lot.
A-of-right whenever a group of adjoining lot in common ownerhip i eparated or the ownerhip of one or more lotchanged, if each of the lot will conform to all proviion of thi chapter, or if the lot are reidential lot and each lotcontained a principal reidential tructure at the time the adjoining lot came under common ownerhip and no changewere made to the tructure or lot during the time in which the lot were commonl owned, in a wa that increaed thenonconforming nature of thee lot.
