32C-290 Settlement Agreement and Release (2-04-14) 140 Williams StreetSettlement Agreement and Release This Settlement Agreement and Release is entered into as this ____ day of February, 2014, by and between Dana Goldblatt and Gregory Goff (“Owners”), Property at 140 Williams Street and the City of Northampton Building Department (“Northampton”) who hereby agree as follows: WHEREAS, The owners performed or allowed to be performed work without permits and by unlicensed workers demolition, framing, electrical, plumbing, insulation, and finishes on the property known as, 140 Williams Street, Northampton, MA (the “Project”); and WHEREAS, the owners seek to resolve all disputes in regard to the work performed on the Project, in an amicable manner without the necessity of further legal proceedings. NOW, THEREFORE, in consideration of the promises, covenants and provisions set forth herein, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the owners and Northampton hereby agree as follows: Upon payment of the appropriate penalty and application fees, Northampton agrees to issue mechanical permits on the Project. Northampton is agreeing as a compromise to accept the conditions of attachment “A” as a path to acceptance and approval of the Project. The fees accessed shall not represent any change by Northampton to its fee structure. The standard fees for work started without permits will be applied and are as follows building and electric fees doubled and plumbing fees tripled, as well as the fee to remove the Stop Work placard. In consideration of the above, the owners agree not to pursue future claims against inspectors and or contractors participating in the acceptance and approvals of work that cannot be visually inspected. In consideration of the above covenants and agreements, the parties do hereby remise, release and discharge each other, including their respective employees, attorneys, agents and consultants, from all claims, demands and liabilities arising out of the Project. The parties represent that they had the opportunity to thoroughly review this Settlement Agreement and Release; that they have read and understand the provisions herein, and that they are voluntarily entering into this Settlement Agreement and Release. City of Northampton Building Department By: By: _______________________________ _______________________________ Dana Golblatt (owner) Kyle Scott Local Building Inspector _______________________________ Gregory Goff (owner) Attachment “A” 140 Williams Street, Northampton, MA All walls covering plumbing and gas piping will need to be opened. If the piping is to code and meets appropriate tests then it could stay assuming the licensed plumber has taken a permit for the work. The instant HW heater is not MA approved nor is the venting appropriate. There is a plumbing vent stack through the metal roof which is too close to a venting skylight. If the skylight is permanently glued and screwed shut from the exterior then the stack could stay, otherwise it must be relocated. The kitchen section will need the plumbing appropriately completed. The electrical will need to be tested (rung out as Roger calls it) circuit by circuit to assure the wiring was run properly and a licensed electrician puts their license on it. The basement wiring must be cleaned up and put in proper order. Smoke and CO detectors must be up to current codes. Photos must be provided showing work within the walls. This work must be a satisfactory indicator of acceptable workmanship by the appropriate contractors and inspectors. Provide the name of the insulation contractor, to verify their license. Provide stamped structural documentation for framing load changes.
