At a meeting conducted on September 23, 1999, the Northampton Zoning Board of
Appeals voted unanimously 3:0 to grant the request of Robert S. Berniche, II for a FINDING
under the provisions of Section 9.3 (1) (D) in the Northampton Zoning Ordinance to change a
pre- existing nonconforming use from a swimming pool filter manufacturing facility,
autobody repair shop and used car sales lot to a facility for the storage and maintenance of
golf course and landscape equipment and the storage of construction equipment at 579
Spring Street, Leeds.
Zoning Board Members present and voting were: Chair Mark NeJame, Bob Riddle and Associate
Member William Brandt.
The Findings of the Board under Section 9.3(1)(D) for a change of a Pre - existing non-
conforming use were as follows:
The Board found that the requested use for storage and maintenance of equipment will
not be substantially more detrimental to the neighborhood than the existing
nonconforming use as a swimming pool filter manufacturing facility, etc.
2. The Board found that the change of the pre- existing non - conforming use: i) will not
extend any closer to any front, side or rear property boundary than the current zoning
allows or existing structure already extends and will not create any new violation of other
zoning provisions; and ii) does not involve a new sign.
The following conditions were imposed with this Finding:

1. Approval is limited to the storage and maintenance of golf course and

extension, modification or renewal thereof, shall take effect until a copy of the decision bearing
the certification of the City Clerk that twenty days have elapsed after the decision has been

Hampshire County Registry of Deeds or Land Court, as applicable, and indexed under the
name of the owner of record or is recorded and noted on the owner's certificate of title. The fee

Minutes of Meeting
September 23, 1999
The Northampton Zoning Board of Appeals held a meeting on Thursday, September 23,1999 at 7:00
p.m. in Hearing Room 18, City Hall, 210 Main Street, Northampton, Massachusetts.
Present were Members: Chair Mark NeJame, Bob Riddle and Associate Member William Brandt.
Staff. Senior Planner John Bennett and Board Secretary Laura Krutzler.
At 6:04 p.m., NeJame opened the Board's regular meeting, introduced Board members and staff, and
explained the procedure he would use in conducting the hearings.
At 7:51 p.m., NeJame opened the Public Hearing on a request by Robert S. Berniche, II, for a
Finding, or whatever other relief is necessary, to change a pre- existing nonconforming use from a
swimming pool manufacturing facility, autobody repair shop and used car sales lot to a facility for
the storage and maintenance of golf course, landscape and construction equipment (a portion of the
building may also be leased in the future to an unidentified tenant) under Section 9.3 (1) (D) of the
Zoning Ordinance for property located at 579 Spring Street, Leeds, also known as Assessor's Map
15B, Parcel 31.
NeJame read the legal notice.
Robert S. Berniche, II, of 19 Audubon Road, Leeds, presented the application, accompanied by
his father, Robert Berniche of Suffield, Connecticut.
The younger Berniche explained that he and his father owned the country club next door, and their
plan was to basically move some of the country club's existing operations to this building, since they
did not have enough space at the country club. Berniche said they would also lease a portion of the
building. He said they did not know at this time who the future tenant would be, but they would like
to find a plumbing contractor looking for a small shop.
In response to a question from NeJame, Robert Berniche, II, said the building was presently used
as a swimming pool filter manufacturing facility which had been in business since the 1940's. He
said the property was also being used for auto body repair and as a used car lot, according to existing

NeJame read into the record a memo from Captain Michael Wall of the Police Department and
comments from Officer R.J. Powers. The memo stated that, after inspecting the property, Powers
had determined that no new traffic problems would result from the change in use.
Bennett said it was likely the proposed additional use would have to return to the Board for a Finding
unless a concrete proposal was advanced which the Board could put its blessing on.
Member Questions.
Brandt asked if the property was presently being used for auto sales?
Berniche, Jr. said it was being used for auto body work. He said there were a number of cars there,
but it didn't look like you could sell any of them.
Brandt commented that it was a residential area, and he didn't want to crank up a business at 5:00
o'clock in the morning when neighbors were trying to sleep if that was not what was already
happening.
The younger Berniche responded that the place where work presently begins in the morning and
where maintenance is done now would move approximately a thousand feet with the new
arrangement. He pointed out that it would not change where he did his mowing. He added that he
had talked to Fairway Village condominiums, and they didn't seem to have a problem.
Brandt asked where they did work now?
Robert Berniche, II, said there were two little buildings going off to the left side, right off the sixth
fairway. He said there used to be a road there before the condos were built, and they were going
to reopen this road. He confirmed they would be doing oil changes, general maintenance, etc. He
noted that there was an existing fence which they were going to leave in place, and everything would
be behind the fence. Berniche clarified that equipment to be stored would consist of vehicles
currently on his property now, including tractors, a backhoe, etc. - they just would be moved about
two hundred feet. Berniche noted that most of the equipment would be inside. The buildings they
had now were not large enough to contain all the equipment, he advised. He commented that
everybody thought it would amount to cleaning up the property.
Members asked questions to clarify the proposal.
The younger Berniche acknowledged he needed to do quite a bit of work before they could even
propose to rent to anybody.
In response to a question from Brandt, Berniche, Jr. said he would probably lease a thousand to
fifteen hundred square feet of the four thousand five hundred square foot (4,500 s.f.) building. He
said he didn't know how much room he would need before he got in there.

Brandt asked if he was going to store any chemicals there, such as weedkillers, etc.?
Berniche, II said yes. He pointed out that his barn was now only ten feet from the river, and that was
one of the reason he was moving.
Joseph Batura of 574 Spring Street asked if a Variance would negate all the grandfathering clauses
for the property, so that there wouldn't be any more pool filter manufacturing company, etc.?
NeJame explained that the owner would have to return for another Finding if he wanted to change
back to those uses. If the applicants sold to someone else who wanted to put in a used car lot, they
would have to return to show that that use was not substantially more detrimental, he elaborated.
Brandt added that the owners would have to come back no matter what the use, unless it was allowed
by right. No matter who the applicants lease excess space to, they will have to come in for a
Finding, he said.
NeJame explained for the audience's benefit that the applicant was proposing to lease a portion of
the property. Unless they were a substantially similar business, they would have to come in for a
Finding as well, he confirmed.
Barbara Batura of 574 Spring Street said her only worry was the fact that Berniche was going to
rent to another person. She commented that, if what Berniche had done to the Country Club was any
indication, the property would have "major beautification" to it. Batura said she thought she could
speak for all those present in saying they were definitely in favor of the proposal.
"This property is a mess - beyond an eyesore," Batura informed members.
She said they all gave their blessings and hoped [the application] would go through.
Bennett said he wanted to make sure members had a clear understanding that storage was to include
golf course maintenance equipment, landscaping equipment, and construction equipment. The
proposal is not limited to golf course equipment maintenance, but includes storage of Tom Fenton's
construction equipment, Bennett clarified. Bennett reiterated the fact that everything would be
parked behind the fence.
NeJame asked if maintenance would just be on Berniche's equipment?
Both Berniches said yes.
NeJame said that hadn't been clear to him. He said he thought storage and maintenance was only
on equipment related to the golf course.
Berniche Jr. said his stuff would all be moved to this part of the property.
NeJame suggested carefully phrasing the motion to reflect that approval was for storage and
maintenance of golf course equipment but storage only of equipment they did not own. He clarified

that the Finding would not be for maintenance of construction equipment. He stressed that he did
not want to grant a Finding that allowed them to maintain construction equipment that was not theirs.
Members discussed alternatives, with Brandt suggesting the condition that the property not become
a commercial repair facility.
Larry LeBeau of 603 Spring Street asked if they were going to put a fence in a particular area?
Berniche Jr. said they didn't intend to put a fence there. He said he would not be opposed to putting
a line of white pines there.
LeBeau noted that now he could see all the junks.
Berniche assured him they were going to go. He said they would be bringing in a car crusher.
Regarding the future lease of a portion of the existing building, Berniche expressed his
understanding that he would need to seek a Finding as soon as he found a tenant.
Riddle moved to close the hearing. Brandt seconded. The motion passed unanimously 3:0.
Brandt moved to grant the Finding with the following condition: 1) Approval is limited to the
storage and maintenance of golf course and landscaping equipment [and storage only of
construction equipment]. A commercial repair facility is not allowed.
In making the motion, Brandt commented that the requested use was not substantially more
detrimental and, in fact, in light of the testimony of neighbors, would actually improve the property.
Riddle seconded. The motion passed unanimously 3:0.

and having spoken to the prosepective buyer, it is my
determination that no new traffic problems would result from
this transaction.
There should not be any increased traffic on Spring Street.
The intended use for the new property is for the storage and
maintenance of equipment used at the Northampton Country
Club. The new land abutts the existing property, making it
basically an extension of the Country Club.
Regarding future use, the prospective owner may
lease /rent a minor portion of this building to a small business. It
should be understood that the type of business should fall
under the zoning guidelines.
