May 2, 2012 Dear Mr. Guerra,
I have reviewed your zoning permit application for an outside dining area at Paradise City Tavern. I have approved the application as presented, including the plan prepared by Douglas
Architects, with the following conditions.
The total occupant load for the entire establishment, including persons seated in the outside
dining area, must not exceed 113 persons. Occupancy must be monitored at all times. The area cannot
include any permanent structures. The proposed dining area must be enclosed by temporary vehicle barriers that are sufficient to provide protection for the patrons. The parking area in the area formerly
occupied by the Jack August restaurant must be improved to meet the requirements of Northampton Zoning 350-8.1 Off-Street Parking Regulations. There shall be no live entertainment in the outside dining area unless specifically permitted by the license board. Any recorded music levels must comply
with Northampton Zoning 350-12.1. Outside lighting must comply with Northampton Zoning 350-12.2. Violation of any of these conditions, or violation of any other zoning ordinance or building code
requirement, will result in withdrawal of this approval and may result in other enforcement actions.
