At a meeting conducted on February 25, 1999, the Northampton Planning Board voted
unanimously 6:0 to grant the request of Tofino Associates for a SPECIAL PERMIT WITH
SITE PLAN APPROVAL under the provisions of Section 6.12 in the Northampton Zoning
Ordinance to construct a common drive to service three residential lots for property located
at Florence Road, also known as Map 37, Parcel 22 as shown on the following plan:
1. "Common Driveway and Flag Lot Special Permit Application/Definitive Subdivision
Plan of Land in Northampton(Hampshire Co.), MA, Prepared for Tofino Associates,
Inc." by Ainsworth Associates, Inc., dated September 17, 1998.
Planning Board Members present and voting were: Vice Chair Daniel J. Yacuzzo, Paul
Diemand, Kenneth Jodrie, Anne Romano, Sanford Weil, Jr. and Associate Member Alton Neal.
In Granting the Special Permit, the Planning Board found:
A. The requested use for a common drive protects adjoining premises against seriously
detrimental uses because the majority of wooded areas on site will be maintained in their
existing state, providing a natural buffer between the development and adjacent
properties. Drainage from the driveway will follow existing drainage patterns.
B. The requested use promotes the convenience and safety of veldcular and pedestrian
movement within the site and on adjacent streets and minimizes traffic impacts on the
streets and roads in the area because the common drive will serve three lots, limiting the

number of curb cuts on Florence Road.
C. The requested use promotes a harmonious relationship of structures and open spaces to
the natural landscape, existing buildings and other community assets in the area because
the majority of wooded areas on site will be maintained, maximizing the amount of land
left in a natural state.
D. The requested use will not overload, and will mitigate adverse impacts on, the City's
resources, including the City's water supply and distribution system, sanitary and storm
sewage collection and treatment systems, fire protection, streets and schools.
E. The requested use meets all special regulations set forth in the Zoning Ordinance under
Section 6.12 - see "Attachment A," for criteria.
F. The requested use bears a positive relationship to the public convenience or welfare
because it will provide access to additional housing.
The use will not unduly impair the integrity of character of the district or adjoining zones,
and the use will not be detrimental to the health, morals, or general welfare. The use is in
harmony with the general purpose and intent of the Ordinance.
G. The requested use will promote City planning objectives to the extent possible and will
not adversely affect those objectives, as defined in City master or study plans adopted
under M.G.L. Chapter 41, Section 81-C and D.
In addition, in reviewing the Site Plan, the Planning Board found that the plan complied with
the following technical performance standards:
F. 1. Curb cuts onto streets have been minimized by the use of a common drive to serve
three lots.
2. Pedestrian, bicycle and vehicular traffic movement on site are separated to the.
extent possible.

Ainsworth Associates and "Common Drive& Flag Lot Special Permit Application,
Notice of Intent 246-440," prepared by The Berkshire Design Group, Inc., dated
September 17, 1998 and revised November 12, 1998 and January 20, 1999.
2. House numbers identifying all of the homes utilizing the Common Driveway shall be
placed at the intersection with the City street(Florence Road) and at any
subsequent forks/turnoffs (e.g. from Mountain Laurel Path) in the Common
Driveway for the purpose of identification by emergency vehicles.
3. Easements shall be placed on the deeds to the lots, including the proposed road on
the Definitive Subdivision Plan, granting access to and over the subject parcels and
shall be recorded at the Hampshire County Registry of Deeds prior to the issuance
of a curb cut/driveway permit.
4. Restrictions shall be placed on the deeds to the subject lots(1,2 and 3 on the
Definitive Subdivision Plan):
A) Prohibiting any additional vehicular access to said lots other than from the
Common Driveway approved by this Special Permit;
B) Stating that said Common Driveway is a private driveway and not a City
way;
C) Stating that said Common Driveway shall be constructed and maintained
with a surface of bituminous concrete (on grades greater than four percent)
5. All municipal utilities to serve the lots shall be placed within the Common Driveway
easement and appropriate utility easements shall be placed on the deeds to subject
properties.
6. All such deed easements, restrictions and plans must be recorded at the Hampshire
County Registry of Deeds and must be submitted to and approved by the
Northampton Planning Board with the submittal of the definitive Subdivision Plan,
prior to its endorsement and the recording of the documents and plans at the
Registry of Deeds.
7. _Prior to-the-issuance-of a Building Occupancy permit the developer shall submit to
the Building Commissioner a certified statement from the project engineer that the
Common Driveway wa's constructed in general conformance with the plans
approved with this Special Permit.
8. In order to prevent the Common Driveway Special Permit from becoming invalid,

the Common Driveway shall be constructed as shown on the approved plans within
two (2) years from the issue date of this Special Permit. A certified statement from
the project engineer that the Common Driveway was constructed in general
conformance with the plans approved with this Special Permit shall be submitted to
the Office of Planning and Development prior to the expiration date of the Special
Permit and become part of the file as proof that the Common Driveway Special
Permit has been exercised.
9. Conveyance of one or more lots with access provided by the Common Driveway to
separate bona fide purchasers shall constitute the exercise of the Common Driveway
Special Permit for the lots served and construction of said common Driveway shall
be permitted. However, conveyance of more than one lot accessed by the Common
Driveway to a single purchaser shall not constitute the exercising of the Common
Driveway Special Permit unless the Common Driveway is constructed in accordance
with approved plans prior to the expiration of the Special Permit.

Section 6.12 Vehicular Egyess/Access to a Lot and Common Driveways. In reviewing the
application for a Special Permit with Site Plan Approval to permit a common driveway, the
Planning Board found the following:
1. The common driveway does not serve more than three (3) lots,
2. The common driveway provides the only vehicular egress/access to the lots being
serviced by it, and this is stated in the deeds to the subject lots,
3. The grade, length and location of the common driveway is of suitable construction for the
access and turn-around of the vehicles which will be utilizing the common driveway.
A. The driveway has a width of at least fifteen(15) feet,
B. The driveway has passing turnouts providing a total width of at least 20 feet along
a distance of at least 25 feet, spaced with no more than 300 feet between turnouts,
and with the first such passing turnout being located within ten feet of the
driveway connection to the street, and
C. The driveway is acceptable to the Department of Public Works and the Fire
Department,
D. The driveway conforms to all other driveway requirements of the Zoning
Ordinance.

In Granting the amended Special Permit with Site Plan Approval, the Planning Board found:
A.The requested use for a flag lot with amended lot lines protects adjoining premises against seriously detrimental uses for the same
reasons stated in the permit approving the original flag lot-that the majority of wooded areas on site will be preserved in their existing
state and that drainage from the driveways and building roofs will follow existing drainage patterns.
B.The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and minimize traffic
impacts on the streets and roads in the area because the flag lot and two other lots will be served by a common driveway, minimizing the
number of curb cuts onto Florence Road.
C.The requested use promotes a harmonious relationship of structures and open spaces to the natural landscape,existing buildings and
other community assets in the area because the majority of wooded areas on site will be maintained,maximizing the amount of land left
in a natural state.
D.The requested use will not overload the City's resources,including the City's water supply and distribution system,sanitary and storm
sewage collection and treatment systems,fire protection,streets and schools.
E.The requested use meets all special regulations set forth in the Zoning Ordinance under Section 6.13-Flag Lot.
F.The requested use bears a positive relationship to the public convenience or welfare by providing additional housing.
The use will not unduly impair the integrity of character of the district or adjoining zones,nor be detrimental to the health, morals, or
general welfare. The use is in harmony with the general purpose and intent of the Ordinance.
G.The requested use will promote City planning objectives to the extent possible and will not adversely affect those objectives,as
defined in City master or study plans adopted under M.G.L. Chapter 41, Section 81-C and D.
In addition,in reviewing the Site Plan, the Planning Board found the requested use complies with the following technical performance
standards:

1.Curb cuts onto streets are minimized because only one new curb cut is requested.
2.Pedestrian,bicycle and vehicular traffic are separated on site to the extent possible.
As required by Section 6.13, the Planning Board found the flag lot has:
1.met the requirements of the Table of Dimensional and Density Regulations, Section 6.2;and
2.an access roadway with no curve having a radius of less than eighty(80)feet or,if access is from another lot,an area on the flag lot for
an access roadway with no curve having a radius of less than eighty(80)feet;and
3.configuration such that the principal structure(erected or to be erected)may be located on the lot in such manner that a circle,with a
minimum diameter equal to one and one-half(1 1/2)times the amount of the minimum frontage requirement required for a non-flag lot in
that district,can be placed around the principal structure without any portion of said circle falling outside of the property's line;and
4.no more than three Flag Lots having abutting,contiguous street frontage. (Only one Flag Lot is proposed.) Contiguous Flag Lots
under common ownership must share one common curb-cut and driveway access. Appropriate easements shall be delineated on the
Plot Plan and on the deeds to the lots,including a clear provision for the responsibility for the maintenance of the common driveway,
common utilities(if any)and snow removal,running with the land. Said easements shall:
A.become part of all of the deeds,and
B.be recorded at the Hampshire County Registry of Deeds or Land Court as applicable(proof of recording shall be submitted to the
Building Commissioner prior to the issuance of any Building Permits).
5.An access driveway with grade,length and location of suitable construction,in the opinion of the Planning Board,for the access and,
where applicable, the turn-around for vehicles,including moving vans,ambulances, fire and police. Said driveway conforms to all
applicable provisions of the Zoning Ordinance.
6.Plans submitted to the Planning Board under this Section shall be the same as the plan submitted to the Planning Board under the
Subdivision Control Law,and shall include the statement'Lot(s) is a Flag Lot: building is permitted only in accordance with the
special Flag Lot Provisions of the Northampton Zoning Ordinance.'
7.The Special Permit application shall include a plan showing the location and layout of the proposed driveway and house and all
provisions for drainage and storm water run-off.

Kohl said the Planning Board had previously approved the flag lot, but the lot lines had since been changed to eliminate protrusions
necessary to accommodate the subsurface sewage disposal system, since arrangements were made to connect to City sewer instead.
Kohl said he went to close on the lot, and the buyer's attorney was not satisfied, so here he was.

Ted Parker of Kohl Construction asked me to write to you regarding the Pathways Co-
housing project, and to explain the modeling, inspection, and testing procedures of the
Energy Star Program.
Each of the 24 housing units at the Pathways Co-housing project in Northampton have
been run through the energy modeling computer program REM/Rate to verify their
compliance (as designed) with the Energy Star Homes program. The Energy Star Home
standard is 86 on the 1 to 100 Home Energy Rating System (HERS) scale, whereas
current Massachusetts energy code is approximately 80. The REM/Rate "building file"
printout details all of the energy features of the building, including: insulation R-values
and thickness, window U-values, HVAC equipment efficiencies, ventilation rates, air
leakage rates, and estimated utility costs. I can provide you with a "building file"for

Each Energy Star Home is allotted two (2) site Inspections, so for the 24 units an Energy
Star project coordinator can be on site at Pathways up to 48 times during the entire
construction process. The first Energy Star Home inspection takes place after the
insulation has been installed and before sheetrock. We look at the quality of the
insulation installation and suggest improvements, if needed. The second and final
inspection involves performing a blower door test to verify that Energy Star Home air
leakage standards have been met. A ventilation flow rate test is also performed at the
final inspection, as well as verification of energy-efficient lights and appliances that
qualify for rebates. Additional site visits can be scheduled if requested.
After a successful final inspection, each of the 24 Pathways Co-housing units will be
certified as an Energy Star Home. I'll do a final REM/Rate model reflecting the "actual"
tested conditions, and generate a rating sheet verifying that each home as-built reaches
an 86 on the HERS scale. The EPA will then send Energy Star Home certificates to each
of the homeowners.
