Plans should be submitted at least 15 days prior to the issuance of any City building permits. a. The plan must be revised to show the elevation and location of the overflow from the rain garden; b. The plans should show a continuous berm around the raingarden higher than the overflow c. Material specifications for rain gardens must be included in construction plans. d. The tree protection detail shall be revised to include protective fencing at the drip line of the tree. 2. Prior to issuance of a Building Permit, the applicant shall record an executed Storm water Operation, Maintenance, and Inspection Agreement that is binding on all subsequent owners of land served by the private storm water management facility by recording it in the land records of the Registry of Deeds. This agreement must be approved by the Northampton DPW prior to final signatures and recording. 3. Prior to construction a. Tree protection shall be inspected by the City. b. Test pits should be completed in the location of the proposed rain gardens to confirm separation to groundwater. 4. Entry lights shall be placed on motion sensor. Wall lights shall be timed to turn off at 11 PM. There are no time limits for the sidewalk lighting. 5. Prior to final certificate of occupancy, the final calculation for tree replacement shall be submitted and replacement shall be completed in compliance with 350-12.3. FINDINGS: The Planning Board approved the site plan for the construction of the 5,000+ square foot mixed use building with parking. The requested use protects adjoining premises against seriously detrimental uses. The mixed use is consistent with other commercial developments in the General Business zone surrounding the site; and 2. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets: the site has a direct pedestrian connection to the public sidewalk to the Accessible entry. Parking is at the rear of the site and: The project, including any concurrent road improvements, will not decrease the level of service (LOS) of all area City and state roads or intersections affected by the project below the existing conditions Access by nonmotorized means has been accommodated with facilities bike racks and sidewalk connections. 3. The site will function harmoniously in relation to other structures and open spaces to the natural landscape, existing buildings and other community assets in the area as it relates to landscaping, drainage, sight lines, building orientation, massing, egress, and setbacks. 4. The requested use will not overload, and will mitigate adverse impacts on, the City's resources, including the effect on the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools. The construction materials and methods for water lines, sanitary sewers, storm sewers, fire protection, sidewalks, private roads, and other infrastructure shall be those set forth in the Northampton Subdivision Regulations 5. The requested use does not trigger any special regulations set forth in this chapter. 6. Compliance with the following technical performance standards: Curb cuts onto streets are minimized. Access to the site is utilizing the existing residential scale curb cut. Pedestrian, bicycle and vehicular traffic movement on site are separated, to the extent possible 7.
