At a meeting held on May 19 1993, the Northampton Zoning
Board of Appeals voted unanimously to GRANT the request of New
England Telephone for a SPECIAL PERMIT under the Provisions of
X5.2, page 5 -3 of the Northampton Zoning Ordinance to construct a
small single story equipment building at #118 Florence Street for
a utility sub - station for fiber optic cable service. The Zoning
Board of Appeals voted unanimously to APPROVE the SITE PLAN REVIEW
under the Provisions of §10.11 of the zoning ordinance. Present
and voting were Chairman Robert C. Buscher, William R. Brandt, and
M. Sanford Weil, Jr.

Conditions are as follows:
1. The applicant must meet the 30' setback requirement or the
applicant must come back to the ZBA for a variance if they
cannot meet the setback requirement.
2. A sketch should be submitted showing appropriate shrubbery to
be planted around the hut. The Office of Planning and
Development shall review and approve the sketch and the plan
for landscaping and maintenance of the shrubbery.
Pursuant to Mass. General Laws, Chap. 40A, §11, no variance,
finding, or special permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed with the City Clerk and
that no appeal has been filed, or if such an appeal has been filed
that it has been dismissed or denied, is recorded in the Hampshire
County Registry of Deeds and indexed under the name of the owner of
record or is recorded and noted on the owner's certificate of
title. The fee for such recording or registering shall be paid by
the owner or applicant. It is the owner or applicant's
responsibility to pick up the certified decision from the City
Clerk and record it at the Registry of Deeds.
The Northampton Zoning Board of Appeals hereby certifies that a
variance, finding, or special permit has been granted and that
copies of this decision and all plans referred to in it have been
filed with the Planning Board and the City Clerk.
Pursuant to Mass. General Laws, Chapter 40A, section 15, notice is
hereby given that this decision is filed with the Northampton City

Zoning Board of Appeals Minutes
The request of New England Telephone for a Special Permit and Site
Plan approval under §5.2, page 5 -2 to construct a small single -
story equipment building at #118 Florence Street for a utility sub-
station for fiber optic cable service. Present and Sitting were:
Chairman Bob Buscher, Bill Brandt, and M. Sanford Weil, Jr. Bob
Buscher read a copy of the Public Notice which was published in the
Daily Hampshire Gazette on May 5 and May 12, 1993. Bob Buscher
read a copy of the May 19, 1993 memo from the Northampton Planning
Board to the ZBA which stated that at its May 13th meeting the
Planning Board voted unanimously to recommend that the ZBA approve
the request of New England Telephone with the condition that a
sketch will be submitted showing appropriate shrubbery to be
planted around the hut. The Office of Planning and Development
will review and approve the sketch and the plan for landscaping and
maintenance of the shrubbery.
Michael Long, representing the New England Telephone Company,
explained the application by reading the description of proposed
work which was included in the application. The description
outlined the plan to place a fiber optic cable to the Florence
Street area of the City of Northampton to modernize service and to
provide for future telephone service demands in that area. The
project involves placing a single -story equipment building called
a Precast Concrete Hut (PCH), to provide a secure environment to
house the equipment necessary to derive regular telephone dial tone
from the signals transmitted through the fiber optic cable. The
dimensions of the PC are 11 wide 14 -1/21 long and 9 high and will
be located on land owned by Frank Newhall Look Memorial Park,
opposite house #118 Florence Street. An existing surface - mounted
equipment cabinet located adjacent to the site will be removed upon
completion of the project.
Ed McCookie, 118 Florence Street, voiced concern about increased
traffic coming and going to the hut. He said he thought there was
a lot of problems with the sub - station that is there now. If the
traffic will be heavier as a result of the new project, he said he
would be opposed to the project.
Ray Elliott, 122 Florence Street, voiced concern about maintenance
of the area and the shrubbery surrounding the proposed new hut.
Sandy Weil moved to close the Public Hearing. Bill Brandt seconded
the motion which passed unanimously.
Sandy Weil reviewed the criteria for granting a special permit and
found that the following criteria was met:

Weil said he was prepared to vote in favor of the applicant. Bill
Brandt said he would like to add that the application is amended to
reflect the 30' setback, and reference to the shrubbery and the
approval of the shrubbery plan by the Office of Planning and
development. Brandt said he would vote in favor of the
application. Bob Buscher agreed with his colleagues and said he
believed that the installation of this updated, state -of- the -art
system will be in the public interest and benefit. Buscher said he
would like to add two conditions:
1. The applicant must meet the 30 setback requirement or the
applicant must come back to the ZBA for the proper approval if
they cannot meet setback requirement.
2. A sketch should be submitted showing appropriate shrubbery to
be planted around the hut. The Office of Planning and
Development shall review and approve the sketch and the plan
for landscaping and maintenance of the shrubbery.
Bill Brandt moved to approve the request for Special permit and
Site Plan approval with the two conditions as listed above. Sandy
Weil seconded the motion which passed unanimously.
The Zoning Board of Appeals adjourned its meeting at 9:30 P.M.
