Appeals of the City of Northampton voted unanimously to GRANT the Application of Northampton Ford, Inc. to modify the Special Permit granted them on August 12, 1985 which allowed construction of their dealership complex on Damon Road, by constructing a small addition to the building. Present and voting were Chairman Dr. Peter Laband, William Brandt, and M. Sanford Weil, Jr. The Findings are as follows: The requested use is listed in the Zoning Ordinance as allowed by Special Permit. The requested use bears a positive relationship to the public welfare in that it provides additional conveniences for customers. The requested use will have no effect on any municipal systems, nor will it have any effect on traffic or pedestrian safety. The requested use will not have any impact on the integrity or character of the district, and is in harmony with the general purpose and intent of the Ordinance. THE FOLLOWING CONDITION SHALL APPLY: 1. The Damon Road facade of the addition must be an extension of the facade of the current showroom. Dr. Peter Laband, Chairman / �CfL William Brandt M. Sanford Weil, Jr. Northampton Zoning Board of Appeals October 4, 1989 Meeting The Northampton Zoning Board of Appeals met at 7: 05 p. m. on Wednesday, October 4, 1989 in Council Chambers, Wallace J. Puchalski Municipal Building, 212 Main Street, Northampton, to conduct a Public Hearing on the Application of Northampton Ford, Inc. to modify a Special Permit granted on August 12, 1985 which allowed construction of the Ford Dealership complex, by constructing a small addition to the building. Present and voting were Chairman Dr. Peter Laband, William Brandt, and M. Sanford Weil, Jr. Ch. Laband opened the Public Hearing by reading the Application, the Legal Notice, and a memorandum from the Northampton Planning Board. Jim Fleming of Associated Builders was present for the Applicant, and explained that business has been so good that Northampton Ford has outgrown their building. In particular, the customer waiting area is not big enough, nor is the lunchroom large enough. The 560 square foot addition will provide a conference room, lunchroom and customer lounge. The only overhead door facing Damon Road will be eliminated and the Mansard roof of the showroom will be continued onto the addition. The existing ten parking spaces in front will remain. There being no one present to speak in favor or in opposition, Mr. Weil moved the Public Hearing be closed. Mr. Brandt seconded, and the motion passed unanimously. Mr. Brandt pointed out that to modify a Special Permit, the procedure is the same as in the original granting of the permit, i. e. , the Section 10.10 criteria must be met. He found that the use is listed in the Table of Use Regulations; there is a positive relationship to the public welfare in providing additional conveniences for customers; there will be no undue traffic congestion created, and pedestrian safety is not a factor; there will be no overload of any municipal systems; the requested use will not impair the character or integrity of the zone. He said he would vote in favor, "but the front of the building must have the same facing as the current showroom. " Mr. Weil concurred, as did Ch. Laband. Mr. Brandt moved that the Special Permit be granted, Mr. Weil seconded, and the motion passed unanimously. Also present, in addition to those mentioned, was R. J. Pascucci, Board Secretary. And the said Zoning Board of Appeals further certifies that the decision attached hereto is a true and correct copy of its decision granting said Variance/Special Permit, and that copies of said decision, and all plans referred to in the decision, have been filed with the City Clerk. The Zoning Board of Appeals also calls to the attention of the owner or applicant that General Laws, Chapter 40A, Section 11 (last paragraph) provides that no variance or spe cial permit, or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed in the Office of the City Clerk and no appeal has been filed or that, if such appeal has been filed, that it has been dismissed or denied, is recorded in the Registry of Deeds for the county and district in which the land is located and indexed in the grantor index under the name of the owner of record or is recorded and noted on the owner' s certificate of title. The fee for such recording or registering shall be paid by the owner or applicant.
