To whom it may concern:
I have been requested to investigate a possible zoning violation regarding
parking requirements at 21-31 Main St. , Northampton, Mass. 01060.
The building in question is of mixed use and according to Atty. Gliserman,
is now separate ownership in at least one case. This case being Fitzwilly's
restaurant.
The parking requirements, reguardless of ownership, must remain the same, in
this case the available parking does not meet the minimum requirements currently
specified in the Central Business (CB) Zone. However there is no mention of
ownership or of financial considerations in reguards to the parking.
Because of this I will take no enforcement action at this time. The parking
must only be available. If the parking is however rented to anyone else, for
any use other than the address in question than this would be considered a
reduction in parking and would be a zoning infraction in the opinion of the
Building Department.
