At a meeting held on April 23 , 1987, the on
Appeals of the City of Northampton, in a split decision, voted
to deny the Variance and Special Permit requests of David F.
Tee e, 285 King Street, Northampton, MA, for the purpose of
constructing three additional floors to an existing one-story
structure which is nonconforming in its lot area and maximum ,
floor area ratio to be used for mixed residential and
commercial purposes at property located at 58-64 Pleasant ::.
Street, Northampton, MA (CB Zone) . Present and voting were:
Chm. Robert C. Buscher, Peter Laband and M. Sanford Weil, Jr.
The findings were as follows:
S. Weil found in viewing the interior of the structure that
the actual ceiling is only 3-4 ' greater than the dropped
ceiling and does not constitute a traiendously high ceiling
which would render the building difficult to-market, as argued
by the applicant; and that raising the requested additional
stories would have a negative effect on the abutting
structure.
Referring to the Variance request under Section 6. 2
regarding maximum floor area ratio, P. Laband found that this
building is unusual in that it is a one-story structure
located in an area where the surrounding structures are 3 and
4 stories; that constructing only one (allowed) additional
story would present a hardship to the petitioner, as it would
present an uneconomical return after renovating this building
into usual and customary design for this district; that the
requested use can be granted without substantial detriment to
the public good, as the loss of light associated with closing
over 6 or 7 windows associated with the increase in stories
I'. can be managed through the use of lighting; and that the
r requested use can be granted without nullifying the purpose or
intent of the Ordinance, as it is desirable to direct growth
to the downtown area, as recommended by Lozano-White & Assoc. ,
Planning Consultants for the City. He stated that he would
not address the parking situation, as the applicant currently
has a petition under consideration with the Planning Board for
the purpose of paying into the Downtown Parking Fund in lieu
of providing physical parking spaces.
Referring Section 9.3 (A) , P. Laband found that a change in
the pre-existing nonconforming structure would not be
substantially more detrimental to the district than the
existing structure.
R. Buscher found that this structure is different, in that
it contains only one story in a zone in which the majority of
structures are 3, 4 and 5 stories; and that relief could be

granted without substantial detriment to the neighborhood or
1 the Ordinance. However, in reviewing the applicant's
allegation that the cost of adding only the allowable
seconded story would be more than the yield would justify, he
found that the applicant is an experienced businessman and
developer and was assuredly aware of all of the issues when he
purchased the property and therefore, a sufficient hardship
has not been presented.

At a meeting held on April 23, 1987, the Planni
of Northampton voted unanimously to deny the request - _ - - -
285 King Street, Northampton, MA, for a Special Permit for the purpose
of paying a fee into the Central Business District Parking Reserve Account
in lieu of providing the parking spaces required in conjunction with the
P petitioner's proposal to add three floors to an existing one-story building
n located at 58-64 Pleasant Street,. Northampton, MA. Public Hearing on this
jk'\ application was held on March 12, 1987 in accordance with the provisions
of Sections 9 & 11, Chapter 40A, M.G.L.
The findings were as follows:
A. There is no need to provide additional parking spaces or to
pay a fee into the Central Business District Parking Reserve
Account in place of providing said spaces (in accordance with
Section 8.11 of the Northampton Zoning Ordinance), as the
Zoning Board of Appeals denied a request for a Variance to
install a third and fourth floor onto the building located at
58-64 Pleasant Street, Northampton. As such, the additional
Special Permit requirements are no longer applicable.
