ORDER TO CORRECT VIOLATION OF THE NORTHAMPTON BOARD OF HEALTH "WOOD SMOKE" REGULATIONS
AT 52 Pencasal Drive, Florence
ORDER ADDRESSED TO:
John C. Crest
DATE January 13, 1986
52 Pencasal Drive
Florence, MA 01060
Dear Mr. Crest:
An inspection at 8:08 a.m. on January 10, 198 6 by a representative of the Northampton
Board of Health revealed that smoke, in excess of 60% opacity, was being emitted from your
chimney at 52 Pencasal Drive for a period of 18 minutes
This condition violates the Northampton Board of Health "Regulations Governing Emissions
From Solid Fuel Burning Devices", the so-called "Wood Smoke Regulations" which went into
effect on November 29 , 1985.
Under authority of Section 31C of Chapter 111 of the Massachusetts General Laws you are hereby
ordered to cease the operation of your wood stove (or other solid fuel burning device at
52 Pencasal Drive Assessor Map 29 , Lot 289 ) in violation of the regulation
Please be advised that any future smoke emissions from your chimney in excess of the 60%
opacity (density) limit will be subject to the prescribed penalities.
You have a right to a hearing regarding this notice provided that a written request for such
a hearing is filed in the Board of Health Office within seven (7) days of the receipt of Weis
notice.
In an effort to assist you in complying with the regulations we have enclosed a copy of our
Guidelines for Reducing Wood Smoke Pollution.
It should be noted that following the guidelines will not only reduce air pollution, but will
be a more efficient use of your stove yielding more heat from less fuel and, also, it is safer
as less creosote is produced.
If you have any questions concerning this notice, or the guidelines for reducing wood smoke
pollution, please do not hesitate to contact the Board of Health Office.
Thank you, in advance, for your anticipated cooperation in our efforts to reduce wood smoke
pollution.
Very truly yours, :
Peter J. McErlain
