The file is on my desk. On 7/20/2011 Wednesday I called Apex Cleaning and spoke to Chery at Apex Health Care (774.230.9264);they provide 4 hours a week of cleaning, shopping, errands,etc.to Connie via MassHealth. Cheryl has worked with Connie for 3 years, often helping above and beyond the 4 hours to try to organize and make progress against the tendency to clutter and not clean. Several cleaners have quit rather than continue working in this apartment, including the last who reported 8 cats. Connie had lost custody of her son to DSS previously when another agencies worker turned her in after working in the apartment. Cheryl was personally supervising the case for awhile,then stepped out for a year, and now has come back after the cleaner who quit in frustration over the cats. Cheryl feels that Connie needs social worker help or something Connie is not getting as there is no sustaining any cleaning in between visits from the cleaner. She reports that Connie and her son routinely throw trash on the floor when they are alone, and clothes are everywhere. Cheryl is particularly concerned about the son sleeping on a bare grey mattress(no linens). Cheryl said Connie is perpetually taking classes at UMass(state funded)but that there is no degree in site, and that this seems to be a distraction from simple housekeeping and cleanliness which might be possible. Cheryl did agree to send a cleaner in after our inspection—she asked if there was trash on the floor,and if the hallway was obstructed, I answered no to both, but said we could not go in Connie's room because of clutter. Cheryl said wondered herself about calling DSS but she has reservations about the son being better off with his father(not sure of his status)or with some placement by DSS;Cheryl hopes we can get some help for Connie that addresses her inability to manage on her own. Observed condition of unit made egress to and from Connie's room greatly obstructed at all times and especially in an emergency. Entire Apartment,especially kitchen:(I) Failure to comply with any provisions of 105 CMR 410.600,410.601,or 410.602 which results in any accumulation of garbage, rubbish,filth or other causes of sickness which may provide a food source or harborage for rodents, insects or other pests or otherwise contribute to accidents or to the creation or spread of disease. Observed conditions of unit, especially kitchen, makes regular cleaning and use of surfaces and storage areas impossible, masking accumulating filth and possibly insect infestations. X—Tenant:Tenant must make door freely operable immiediately. Tenant must maintain room in an orderly fashion after thorough cleaning occurs. X—Tenant: Tenant must clear surfaces, discard excess items, and food storage&preparation surfaces especially made usable. Healthy and sanitary conditions must be maintained in the future. Bathroom: 410.500:Owner's Responsibility to Maintain Structural Elements Every owner shall maintain the foundation,floors,walls,doors,windows, ceilings, roof,staircases, porches,chimneys,and other structural elements of his dwelling so that the dwelling excludes wind,rain and snow,and is rodent- proof,watertight and free from chronic dampness,weathertight,in good repair and in every way fit for the use intended. Further, he shall maintain every structural element free from holes,cracks,loose plaster,or other defect where such holes,cracks,loose plaster or defect renders the area difficult to keep clean or constitutes an accident hazard or an insect or rodent harborage. Bathroom floor heating unit is severely corroded, rendering it difficult or impossible to clean. X-Meadowbrook Management: repair/replace as needed. THE FOLLOWING IS A BRIEF SUMMARY OF SOME OF THE LEGAL REMEDIES TENANTS MAY USE IN ORDER TO GET HOUSING CODE VIOLATIONS CORRECTED. 1. Rent Withholding(General Laws Chapter 239 Section 8A). If Code Violations Are Not Being Corrected you may be entitled to hold back your rent payment. You can do this without being evicted if: A. You can prove that your dwelling unit or common areas contain violations which are serious enough to endanger or materially impair your health or safety and that your landlord knew about the violations before you were behind in your rent. B. You did not cause the violations and they can be repaired while you continue to live in the building. C. You are prepared to pay any portion of the rent into court if ajudge orders you to pay for it. (for this it is best to put the rent money aside in a safe place.) 2. Repair and Deduct(General Laws Chapter 111 Section 127L). This law sometimes allows you to use your rent money to make the repairs yourself. If your local code enforcement agency certifies that there are code violations which endanger or materially impair your health, safety or well-being and your landlord has received written notice of the violations, you maybe able to use this remedy. If the owner fails to begin necessary repairs (or enter into a written contract to have them made)within five days after notice or to complete repairs within 14 days after notice you can use up to four months' rent in any year to make the repairs. 3. Retaliatory Rent Increases or Eviction Prohibited (General Laws Chapter 186, Section 18 and Chapter 239 Section 2A). The owner may not increase your rent or evict you in retaliation for making a complaint to your local code enforcement agency about code violations. If the owner raises your rent or tries to evict within six months after you have made the complaint he or she will have to show a good reason for the increase or eviction which is unrelated to your complaint. You may be able to sue the landlord for damages if he or she tries this. 4. Rent Receivership(General Laws Chapter 111 Sections 127C-H). The occupants and/or the board of health may petition the District or Superior Court to allow rent to be paid into court rather than to the owner. The court may then appoint a "receiver" who may spend as much of the rent money as is needed to correct the violation. The receiver is not subject to a spending limitation of four months' rent. 5. Search of Warranty of Habitability. You may be entitled to sue your landlord to have all or some of your rent returned if your dwelling unit does net meet minimum standards of habitability. 6. Unfair and Deceptive Practices (General Laws Chapter 93A) Renting an apartment with code violations is a violation of the consumer protection act and regulations for which you may sue an owner. Do this first, for your safety and your sons'safety. You must keep your apartment clean enough so that insects and germs do not create unhealthy conditions for you to live in. You have too much stuff in too small a place, which makes effective cleaning impossible—but by picking up, putting things that you need away, and throwing away things you don't need, your apartment can be a better place to live for the two of you. Your kitchen and your bedroom are the worst places, but your son's bedroom, the living room, and the bathroom are also very cluttered. There were no sheets on your son's bed at all at the time of inspection. You must accept help if you cannot do these things for yourself, and try to maintain as best you can the cleaning that others help you with. - You are only allowed to keep one cat in your apartment, and Meadowbrook is going to see that you only have one within 60 days. They are also going to enforce this with your neighbors, which is fair. This will also make your apartment a healthier place for you and your son. - Meadowbrook must for their part take a more active role in maintaining your apartment—the bathroom heater is in a filthy condition but because it is so rusty it is too hard to clean. They will repair or replace the cover, and they will look over the apartment when it is clean enough to see surfaces and conditions. If they find more work that needs doing they must then make arrangements to fix your apartment. We expect to see compliance with the pets rule in two months, and all other points within one month, or at least substantial progress. Mandated and non-mandated reporters report suspected instances of abuse of a person with a disability by filing a verbal report with the DPPC Hotline at 1-800-426-9009 and by submitting a written report to the DPPC. Based on the person's reported disability, the report is then forwarded to the Massachusetts Rehabilitation Commission(MRC)Protective Service Program,the fepartment of Mental Retardation(DMR)Investigation Unit or the Department of Mental Health(DMH)Investigation Unit for the purpose of conducting an investigation and providing services to the abused individual.
