Remedies and Penalties Part of the Inspection Report contains a brief summary of some legal remedies tenants may use in order to get Housing Code violations corrected. Failure to comply with this order also subjects the person ordered to a criminal fine of not less than ten ($10. 00) dollars, nor more than five hundred ($500) dollars for each day's failure to comply with this order. Rent Withholding (General Laws Chapter 239 Section 8A) If Code Violations Are Not Being Corrected you may be entitled to hold back your rent payments. You can do this without being evicted if: A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger or materially impair your health or safety and that your landlord knew about the violations before you were behind in your rent. B. You did not cause the violations and they can be repaired while you continue to live in the building. C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this it is best to put the rentmoney aside in a safe place.) 2. Repair and Deduct (General Laws Chapter 111 Section 127L). The law sometimes allows you to use your rent money to make the repairs yourself. if your local code enforcement agency certifies that there are code violations which endanger or materially impair your health, safety or well-being and your landlord has received written notice of the violations, you may be able to use this remedy. If the owner fails to begin necessary repairs (or to enter into a written contract to have them made) within five days after notice or to completerepairs within 14 days after notice you can use up to four months'rent in any year to make the repairs. 3. Retaliatory Rent Increases or Evictions Prohibited (General Laws Chapter 186,Section 18 and Chapter 239 Section 2A). The owner may not increase your rent or evict you in retaliation for making a complaint to your local code enforcement agency about code violations. If the owner raises your rent or tries to evict within six months after you have made the complaint he or she will have to show a good reason for the increase or eviction which is unrelated to your complaint. You may be able to sue the landlord for damages if he or she tries this. 4. Rent Receivership (General Laws Chapter 1111 Sections 127tH). The occupants and/or the board of health may petition the District or Superior Court to allow rent to be paid into court rather than to the owner. The court may then appoint a "receiver"who may spend as much of the rent money as is needed to correct the violation. The receiver is not subject to a spending limitation of four months' rent. 5. Breach of Warranty of Habitability. You may be entitled to sue your landlord to have all or some of your rent returned if your dwelling unit does not meet minimum standards of habitability. 6. Unfair and Deceptive Practices (General Laws Chapter 93A). Renting an apartment with code violations is a violation of the consumer protection act and regulations for which you may sue an owner. I called the Board of Health a few days after receiving notice and told them that installing a very expensive central heating tem ($5,000. 00 + ) which was not only expensive and beyond our financial ls, but was also not needed. We agreed that if some kind of heat was tailed in the bedroom it should bring everything up to code due to the ant of heat emanating from thekitchen unit and infiltration of heat n the below apartments. He couldn ' t wake Jason Suchane either elling or shaking him. He turned off the gas range and disabled the detectors . ughout her tenancy complaints from other tenants about noise, domestic its, running up and down the stairs, and intoxication were abundant. everal occasions, police were called there. Finally on August 31, 1990 the police were called two times in one night and tenants and neighbors >lained again - enough was enough. We mailed out an eviction notice received the reply in writing from Marina Vlassis that she would be by November 1, 1990. Still she denied us access to the apartment while :ing in her letter dated September 24, 1990 that she would allow us ass. Since it was becoming impossible to get into her apartment to repairs we then decided to wait until after November 1, 1990 to do inside repairs needed. )f November 1 , 1990, we rented the apartment for residential storage i to a man who didn 't want to live in it for awhile, but wanted to store furnishings until we could repair the Board of Health items. When I fight the new tenant to see the inside of the apartment on November 1 , 3 , approximately 9 a.m. , the door was unlocked and the aprtment was ty except for a broken chair, a severely broken and tapped vacuum aner, and a telephone. The Gas Company had turned off and locked the meter, and the phone was disconnected, both at Marina Vlassis ' s uest. November 1, 1990, at approximately 4, 15 p.m. I was served a temporary training order from the trial court of Massachusetts, Northampton ision, Docket #9045CV699 further excluding me from the premises and m recovering or attempting to recover possession of same. then obtained legal counsel to deal with the court and its bureaucracy. end result of all negotiations was that as of November 1, 1990 both ina Vlassis and Jason Dushane have vacated the apartment.
