This Department has received a complaint from Rex Kidd of
91 East Mountain Road, Westfield, MA regarding 105 CMR 410.000
Minimum Standards of Fitness for Human Habitation. The location
of the problem is the attic dwelling unit at 382 Pleasant Street,
Northampton occupied by Carrie Kidd and Julie Chrostowski . The
complaint concerned the following conditions :
- two female adults and one child living in one bedroom
- rats in the attic
- fire hazard due to unsafe wiring in the bathroom and bedroom
(electrical fixture handing loosely from the ceiling in the
bedroom with ten extension cords connected to it
- an additional two males visit occasionally; it is questionable
whether these men sleep there at night
- chimney is unsafe
- roof is unsafe
- roof occasionally leaks spilling water onto electrical wiring
As you are aware, the local Board of Health/Code Enforcement
agency has the authority and responsibility to enforce various
Sanitary Code regulations in order to protect the health and safety
of the public. In accordance with this authority the above complaint
is being referred to your Department for investigation and any
necessary enforcement procedures.

E FOLLOWING IS A BRIEF SUMMARY OF SOME OF THE TENANTS LEGAL REMEDIES.
Rent Withholding(General Laws,Chapter 239 Section 8A)
"ode Violations Are Not Being Corrected you may be entitled to hold back your rent payments. You can do this without

(A) You can prove that your dwelling unit or common areas contain code violations which are serious enough to
endanger or materially impair your health or safety and that your landlord knew about the violations before you were
behind in your rent.
B) You did not cause the violations and they can be repaired while you continue to live in the building.
C) You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this it is best to put
the rent money aside in a safe place.)
Repair and Deduct(General Laws, Chapter 111 section 127L)

Rent Withholding(General Laws,Chapter 239 Section 8A)
Code Violations Are Not Being Corrected you may be entitled to hold back your rent payments. You can do this without

(A) You can prove that your dwelling unit or common areas contain code violations which are serious enough to
endanger or materially impair your health or safety and that your landlord knew about the violations before you were
behind in your rent.
B) You did not cause the violations and they can be repaired while you continue to live in the building.
C) You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this it is best to put
the rent money aside in a safe place.)
