Dear Attorney Walaesek: On March 25, 1980 the Northampton Board of Health approved your request for an exten- sion of time to correct housing code violations in the 2nd floor apartment at 4 Bixby Court, lot 160, map 32A, Northampton. The timetable for correcting those violations (refer to Board of Health order dated March 19, 1980) will now go into effect on April 28, 1980, when you will have the authority to pay the debts of the Frederick G. Bixby estate. It is requested, however, that the repair work commence as soon as possible, to insure completion by the new deadline. It is further requested that arrangements be made for the Code Enforcement Inspector to view the lat floor apartment at 4 Bixby Court, so as to determine the cause of the sagging kitchen floor in the apartment above. This letter will certify that the inspections revealed violations listed below, which are serious enough as to endanger or materially impair the health, safety, and well-being of the occupants Under authority of Chapter III, Section 127 of the Massachusetts General Laws, and Chapter 11 of the State Sanitary Code, you are hereby ordered to make a good faith effort to correct the following violations within TWENTY-FOUR HOURS of the receipt of this order. IULATION VIOLATION REMEDY 552 Egresses at 4-6 Bixby Court and the sidewalk in front of 62 Hawley Street is not being maintained in a safe, passable condition. Excessive accumulations of ice and/or snow noted and no attempt(s) at even sanding said egresses and walkways appear to have been taken. Take immediate action to correct said violations. In the future, insure that said walkways/egresses are properly maintained, or that proper, legal action has been taken to channel such responsibilities to other individuals. NOTE: I have attached a copy of the specific housing code regulation. Note that the tenant responsibility for such maintenance (for exclusive egresses only) must be spelled out in a written letting agreement that so states their responsibility. Otherwise, the onus of responsibility and any potential liabilities falls back to the owner. In any instance, the main front sidewalk is the owner's responsibility. Inspection of the premises was made on January 22, 1999 at approximately 10.15 am. If you have any questions regarding this abatement order contact the Board of Health office.
