The Department did so as there is no material dispute in this matter. "therefore, in accordance with the Massachusetts Wetlands Protection Act(the Act) (MGL c. 131, § 40), the Department hereby issues the following Superseding Determination of Applicability (SDA). This SDA is positive for a portion of the "area" described in the Request for a Determination of Applicability (RDA or WPA Form 1) submitted on April 27, 2016. This SDA is negative for the "work" described in RDA, namely construction of a single-family house with driveway, subsurface sewage disposal system, and appurtenances, all as described within the RDA and shown on the plan of record. The Department has determined that the portion of said "area" shown on the site plan approved herein is An Area Subject to Protection Under MGL c. 131, § 40, or a Buffer Zone thereto, as had previously been determined by the Northampton Conservation Commission in plans of record the Commission approved in an Order of Conditions for Wetlands File Number 246-0655, issued by the Commission on October 28,2011. These plans of record are binding as to the "boundaries" of"Resource Areas" (each as defined at 310 CMR 10.04) purposefully shown thereon until such time as a Certificate of Compliance is sought and obtained by the permittee, and that Certificate is recorded at the appropriate Registry of Deeds. The Department has determined that said "work" will not occur within a Resource Area or a Buffer Zone thereto,and is therefore not subject to MGL c. 131, § 40. Additionally, this SDA only legally applies to the area described in the RDA/specific to proposed work shown on the"plans of record", and has no bearing on other portions of the parcel in question, or other adjacent or proximate land.
