No heat since Friday; chronic problem. ) Inspection (pm) revealed temp. range from 56' - 66° F; fire alarm stem (zone 4) not malfunctioning; front entry door electrically locking chanism missing and door unsecure; and roaches in bathrooms. nuary 15, 1991 Complaint received from Wendy Kane of WMLS for tenant, William Amador. heat this past week. Manager told him to call legal services. 1 24 Hour Abatement Order sent to owner regarding violations noted on ring January 14, 1991 inspection. Owner was ordered to respond, in writ- g within 24 hours, as to what action(s) will be taken to correct all the olations noted. A Copy of this order was also sent to Wendy Kane. nuary 16, 1991 Complaint received from Roger Tremblay (Rm 30) re: inadequate heat . 1 Inspection (am) 2nd floor Bathroom temp. borderline 68'F. nuary 17, 1991 1 Complaint received from Craig Dunlap (Rm 191 re: no heat in his room. ) Inspection (pm) 2nd floor bathroom = 62° F / 3rd floor bathroom = 63°F nuary 18 1991 ) I received a telephone call from Mr. Wickles. He informed me that all e violations will be corrected and he is in process of finding a new nager for the building. He also indicated that Barbara Fenton is not nger associated with the building and to direct any further orders to him P.O.Box 374 , Hatfield, MA 01038. .Mr. Wickles again was asked to respond writing, as directed in the abatement order. ) Inspection (pm) Heat satisfactory at this time. nuary 22, 1991 (am) spection revealed heat on but temperatures varied widely depending on ere taken. They insisted that bathrooms were cleaned yesterday t that it is "hard to keep up because certain tenant abuses. This letter will certify that the inspections revealed violations listed below, which are serious enough as to endanger or materially impair the health, safety, and well-being of the occupants . Under authority of Chapter III , Section 127 of the Massachusetts General Laws , and Chapter II of the State Sanitary Code, you are hereby ordered to make a good faith effort to correct the following violations within TWENTY-FOUR HOURS of the receipt of this order: EGULATION VIOLATION 10. 151 Shared bathroom facilities are insanitary; accumulation of soil on floors and fixtures indicates that cleaning is only sporadic at best. 10.480 Room # 33 with damaged entry door/ locking mechanism. REMEDY Hire a permanent, rel maintenance person to tenant "shared" areas satisfactory manner. able clean in a Repair/replace entry door/ frame/ and or locking device in a manner which will allow the occupant to reasonably secure his dwelling unit from unlawful entry. Adjust boiler so that proper temperature is maintained to produce steam capable of heating the entire building . Box 374 Hatfield,MA 01038 RE: Joseph LaVigne 96 Pleasant Street #21 Northampton, MA 01060 Dear Mr. and Mrs.Wickles: This is a written demand for relief made on behalf of Joseph LaVigne pursuant to M.G.L Ch. 93A, §9 for the unfair and deceptive practices and acts set out below. When you purchased the building at 96 Pleasant Street on December 27, 1985, Mr. LaVigne was already a resident. At the inception of his tenancy you impliedly warranted that his room and the common areas in the building were safe, and met the minimum standards of fitness and safety established by state and local law. However, on numerous occasions, the building has not complied with these standards. You have repeatedly failed to provide sufficient heat for his room and for the common areas. On October 3, 1988 you were cited for inadequate heat in violation of the State Sanitary Code at 105 CMR §410.201 for your failure to turn on the heating system for the season. On January 24, 1990, Mr. LaVigne and another tenant complained to the Board of Health that there had been no heat in the building since the day before. Last winter there were constant problems with the heat. Several tenants, including Joseph LaVigne, complained to the Board of Health about heat. In December the building manager informed the Board of Health that there had been no heat for an entire week. On January 15, 1991, the Northampton Board of Health ordered you to comply with the heating requirements of the State Sanitary Code within twenty four hours. However, in spite of this order,the Board of Health continued to receive complaints from tenants regarding problems with heat,and it took until the end of February for the heat to be adequately maintained. Your failure to provide heat after repeated requests to do so by your tenants and the Board of Health constitutes a willful violation of M.G.L. ch. Kt(cidx �1911J 2 186,§14 and a violation of M.G.L. ch.93A. (See Attorney General Regulations at 940 CMR§§3.17 (1)(b) and 3.17 (6)(f).) The common area bathrooms are frequently in a filthy and unsanitary condition. The bathrooms are not cleaned every twenty four hours as required by the State Sanitary Code at 105 CMR §410.151. The Northampton Board of Health has cited you several times for your failure to keep the third floor bathrooms clean, beginning in December, 1987, and most recently on March 15, 1991. The condition of the bathrooms has constituted a willful breach of the covenant of quiet enjoyment in violation of M.G.L ch. 186, *14 and is in violation of M.G.L ch. 93A. (See 940 CMR §§ 3.17(1)(b) and 3.17 (6)(f).) There has also been a severe problem with cockroaches in the building. A short time after you purchased the building your agent was notified on February 28, 1986 that the entire building was infested with cockroaches. Since that time the building has been cited for roach infestation at least once each year,with the most recent time being on December 10, 1990. The failure to insure that the building has been cockroach free after several complaints by the Board of Health constitutes a willful breach of the covenant of quiet enjoyment in violation of M.G.L. ch. 186414 and is in violation of M.G.L ch. 93A. (See 940 CMR §§3.17 (1)(b) and 3.17 (6)(f).) Another problem with the condition of the building has involved the electricity. Since the beginning of 1989, there have been problems with the electricity going off on a regular basis. Mr. LaVigne has notified managers David Mathieson and Gretchen Bishman of this. However it continues to occur. This is a violation of the State Sanitary Code at 410 CMR §410.255. It also constitutes a willful breach of the covenant of quiet enjoyment in violation of M.G.L. ch.186,§14 and of M.G.Lch. 93A.(940 CMR §3.17). For a number of years, there have been constant disturbances in the building caused by other residents and visitors to the building that take place during all hours of the day and night. On several instances, the front entrance door has not had a functioning lock which is in violation of the State Sanitary Code. 105 CMR§410.480. Occasionally there have been fires in the building, thefts and acts of violence. This problem is especially serious on the first two floors of the building. Mr. LaVigne is always fearful of who he might encounter going to and from his room. In March he caught another tenant trying to break into his room. This was especially distressing because the same tenant had previously assaulted an individual with a chain saw. Last year Mr. LaVigne was offered a Section 8 subsidized unit on the first or second floor. Even though under the subsidy his rent would be limited to 30% of his income, and he was already paying more than 80% of 3 his income in rent, he turned it down. He was fearful of moving down to the second or first floors due to the violence and constant disturbances. Mr. LaVigne has complained to managers Jim Sharpe, David Mathieson and Gretchen Bishman and to Thomas Wickies. The failure to insure that the building is reasonably safe and reasonably quiet constitutes a breach of the covenant of quiet enjoyment pursuant to M.G.L ch. 186414. Since you have been notified of the problem on numerous occasions, this is a willful violation of M.G.L ch. 186414 and of M.G.Lch. 93A. (See 940 CMR § 3.17 (6)(f).). On March 1, 1991 you issued Mr. LaVigne a notice to quit for nonpayment of rent. At the time, the rent for Mr. LaVigne's room was $260.00 a month. It was paid each month by protective payments through the Department of Public Welfare. The notice stated that he owed$40.00 for the months of January, February and March, 1991. Mr. LaVigne had received oral notice a few days earlier from the building manager, Gretchen Bishman, that you desired his rent to go from$260.00 a month to $300.00 a month. He did not agree to this increase, and he never received written notice of a proposed rent increase. The issuance of this notice constitutes an unfair and deceptive practice in violation of M.G.L. ch. 93A, §§2 and 9. Because of the violations listed above, Mr. LaVigne has suffered and continues to suffer financial loss and injury as follows: a. For your willful failure to insure that the building was reasonably quiet and peaceful in violation of M.G.L. ch. 186 *14, Mr. LaVigne is entitled to $1,576.00 plus $94.00 for each month that you repair in a subsidized unit; b. For your failure to sufficiently heat the building Mr. LaVigne is entitled to $2,530.00; c. For your failure to insure that the common area bathrooms have been kept in a sanitary manner Mr. LaVigne is entitled to $2,600.00; d. For your failure to insure that the building is free from cockroaches Mr.LaVigne is entitled to $2,708.00; e. For your failure to insure that the electrical service to the building is uninterrupted Mr. LaVigne is entitled to $840.00- three months' rent pursuant to M.G.L ch. 186, §14; £ For your issuance of a notice to quit in violation of M.G.L ch. 93A, §§2 and 9 Mr. LaVigne is entitled to $25.00. 4 f. I am representing Mr. William Amador. Mr. Amador has resided at 96 Pleasant Street since October 30, 1990. Since he moved in, there have been constant disturbances caused by other residents and visitors that take place during all hours of the day and night. On numerous occasions after Mr.Amador moved into the building, the front entrance door has not had a functioning lock which is in violation of the State Sanitary Code. 105 CMR §410.480. Occasionally there have been fires in the building, thefts and acts of violence. The lack of safety and quiet in the common areas has caused Mr. Amador emotional distress; he has been fearful for his safety. Mr. Amador attempted to contact you about this situation. On January 25, 1991, he met with you (Thomas Wickles ) and Marla Gale of the Hampshire Community Action Commission and requested immediate action. When no action was taken he eventually complained to the Housing Allowance Project and the building manager, Gretchen Bishman. As a result, he was moved to a quieter room on the second floor on or around March 8, 1991. Even with the change in rooms, Mr. Amador continues to be disturbed by neighbors and guests in the building. On one occasion in June, 1991, an individual attempted to break into his unit. This took place while Mr. Amador was in his room, and it was a very disturbing experience. The failure to insure that the building is reasonably safe and reasonably quiet constitutes a breach of the covenant of quiet enjoyment pursuant to M.G.L ch. 186, §14. Since you have been notified of the problem on numerous occasions, this is willful violation of M.G.L Ch. 186, §14 and a violation of M.G.L ch. 93A. (See Attorney General Regulations at 940 CMR §3.17 (6)(0). At the inception of William Amador's tenancy,you impliedly warranted and represented that the premises were safe and met the minimum standards of fitness for human habitation established by state and local law.
