This letter will certify that the inspections revealed violations
listed below, which are serious enough as to endanger or
materially impair the health, safety, and well-being of the
occupants. - -
Under authority of Chapter III, Section 127 of the Massachusetts
General Laws, and Chapter II of the State Sanitary Code, you are
hereby ordered to make a good faith effort to correct the
following violations within SEVEN DAYS of the receipt
of this order:

The Northampton Board of Health has inspected the premises at
41 West Street, #3, Northampton, MA (assessor's map 31D parcel 54 .),
for compliance with Chapter II of the State Sanitary Code.
This letter will certify that the inspections revealed violations listed below,
which are serious enough as to endanger or materially impair the
health, safety, and well-being of the occupants
Under authority of Chapter III, Section 127 of the Massachusetts General
Laws, and Chapter II of the State Sanitary Code,you are hereby ordered to
make a good faith effort to correct the following violations
within TWENTY FOUR HOURS of the receipt of this order.

VIOLATION
Extremely poor sanitation throughout
the small apartment. Garbage and
trash strewn about premises. Very
strong smell of urine permeates the
entire unit.
REMEDY
Immediately cleanup and deodorize
the entire apartment. Maintain
premises in a sanitary condition in the
future.
Inspection of the premises was made on May 17, 2000 at approximately
1:30 p.m.
After receiving a request from the Northampton Police Department shortly
after 1:00 p.m., May 17, 2000, I conducted an inspection of your apartment
at which time the conditions above were noted. I was informed that you
were found lying on the floor, an ambulance was called, and you were taken
to Cooley Dickinson Hospital prior to my arrival.
It is my determination that your apartment, in its present state, is "unfit for
human habitation" and you that you should not be allowed to re-occupy the
premises until such time as the violations noted have been remedied to the
satisfaction of the Northampton Board of Health.
Further, it is my opinion that you may no longer be physically capable of
maintaining the premises in a reasonable and sanitary manner. I cannot see
how any reasonable person viewing current conditions in your apartment
could feel otherwise. Said conditions are not only a threat to your health
and well-being, but also to other tenants occupying the dwelling. I shall
further request that the owner of the property begin eviction proceedings
and I will petition the court to allow the owner to enter the premises for the
the premises for the purposes of cleanup, should the apartment not be
brought up to a suitable, habitable level immediately.

Dear Ginny Curtis:
We are writing in order to notify you that 2 health code violations in which we had
spoken to you about previously (the ant infestation and a leaky ceiling in the bathroom)
remain. These conditions make it so that we are unable to live in sanitary and safe living
conditions.
We first notified you about the leaky ceiling in the beginning of November of 2002, and
although it is my understanding that you have had someone working on the job,
beginning the week of April la. (only after we notified the Board of Health about your
negligence) it has continued to leak during the most recent rainstorms,which took place
sometime during the week of April 15,2003. If in fact,the job is complete, than a
contractor should have also assessed the damage to our ceiling, and subsequently,made
appropriate repairs. If the job is not complete, than we continue to live in a situation that
violates Housing Code 410.500,in which it states that ceilings must be free of holes,
cracks, and loose plaster,and must be cleanable and weathertight. Two weeks has
allowed more than enough time to repair the water damage, loose plaster, holes and
cracks in our ceiling as a result of this leaky roof.
In addition, the ant problem that we spoke about on March 7,2003, remains unresolved,
and in fact, has only worsened with the arrival of the warmer weather. During that
conversation,you assured me that you would have an exterminator here that week. In the
meantime, I agreed to purchase ant traps to see if that remedied the problem. The traps
have not been effective,and we are still awaiting the arrival of the exterminator. In fact,
the ants have now traveled into our kitchen. This is a violation of Housing Code
410.550, which states that a cockroach, insect or rodent infestation must be fixed within 5
days of notification.
As an immediate response to these unresolved complaints, and the unsanitary and unsafe
living conditions of our dwelling, we expect that you will resolve these persistent
problems by no later than April 30`". If these conditions are not repaired,we will
withhold next month's rent, until you respond appropriately.
