McErlain and Mayor Ford: It has come to our attention that Northampton has unlawfully inspected our house and caused harm and concern to our tenants at 142 North St. by actions of 3:00 p.m. September 3rd and approximately noon and 5:30 p.m. on September 4th. On September 3rd, 1996, at approximately 3:00 p.m., Peter J. McErIain entered our property unlawfully without our permission for Northampton's first action. He was found on the property unannounced and could have been mistaken as a burglar. At noon on September 4th, you attempted a second search,but were told to leave. At 5:30 p.m. you came back with a warrant and proceeded to violence. You never gave us any notification of alleged code violations or time to fix them before you proceeded to violence and harassment This is your first inspection of our property. This is not a case of a landlord refusing to fix something. What happened was that Northampton employees slanuncd an occupant up against the wall and seized his id by force in the September 4th "search." The excessiveness of the Northampton reaction reveals its in-ational motivations.This must cease immediately and restitution made to those psychologically affected by this violence, McErlain has claimed that a former tenant asked for the initial inspection; however, Erica Moss had already voluntarily relinquished her room at [42 North St. as can be attested to by witnesses ,md her empty roam. Erica Moss's father was not a party to the agreement and his anger will not be relevant in court should this matter come to court except to prove your motivations and his motivations relevant to our collecting damages and tenants' collecting damages. Erica Moss's father IS NOT and has never been a tenant or party to any agreement with us. In fact, his presence on the property with Peter J. Me&rlain on September 3, 1996 constitutes criminal trespass and we demand that Northampton not let it happen again. Peter J. McErlain's claims are belied by the fact that Erica Moss was not present at the time of the criminal trespass thus again proving that she relinquished possession under the generous terms of our leasing agreement counter to most leases which require a 12 month commitment.We only require a month-to-month notification by tenants for them to leave thus potentially saving them thousands of dollars in the event that no substitute tenant could be found as has been demonstrated to happen at 142 North St. in the past. The inspection of the house and unlawful search of the persons of the occupants with a warrant that said "house" will be cause for us to collect damages against the city. In addition, the falsehoods you spread to our tenants are not protected speech. We remind you that the laws concerning commercial speech make it rather easy to collect damages and prove the equivalent or libel. Therefore,your fascist shakedown of our tenants and misrepresentation of the matter at hand will he ample grounds for collection of damages. If any tenants should leave the house because of your unlawful entry, slander, harassment and abetting of criminal trespass threatening the physical and psychological security of our tenants faced with bureaucrats and irate fathers marching around the property,the city and Erica Moss's father will be liable for lost rent. The tantrums of a petty, snooty and financially motivated father overreacting to his daughters decision to leave the nest to live in a house he decided is not good enough against his daughter's earlier judgment will make it easier for us to claim malicious intent in court,when such proof is not required in the context of commercial speech.We will thus establish motivations and collect damages and legal expenses should the matter proceed. Already we have spoken with tenants shaken and disgusted with the way Northampton handled this obnoxious and overprotective patriarch, Should those tenants leave to avoid this sort of conflict, you will be held liable for our business lost, The violence and searches must cease immediately.
