NOTICE OF NON-COMPLIANCE WITH ONE OR MORE LAWS

Dear Property Owner(s):
According to the records at the Assessor's Office,you are the owner of the property of the above
address.
An inspection conducted by this department on 8/5/2015 (notice of violations received from
Northampton Fire Department] has revealed violations with one or more of the following laws.
The Massachusetts General Laws, Chapter 111, Sections 122, 123, 124 and 125, Abatement of
Nuisances; Northampton Code of Ordinances, Chapter 272, Solid Waste; or Chapter 1I of the State
Sanitary Code.
Listed below is a description of the violation(s):
NFD Engine 1 responded to a complaint of smoke in the area and the source was
determined to be a tipped over burn barrel with still-smoldering trash in it,located on the
property at 65 Barrett Street. This behavior is in violation of MA General Law Part 1,Title
VII,Chapter 48,Section 13: Setting Open Air Fires,which allows a fine of up to $500 plus
the cost of suppression or imprisonment for up to one month,and also MA General Law
Chapter 111 Section 122 Public Health Nuisance Law which allows a fine of up to$1000
for each instance of violation. This letter constitutes a warning to the property owners
that any further incidents of this type will cause fines to levied against you,the property
owners.
You are hereby ordered to correct the violations and maintain the property free of violationS in
the future. Re-inspections for compliance with this order will be conducted. IF THE
VIOLATIONS ARE NOT MAINTAINED CORRECTED,YOU WILL BE SUBJECT TO RECEIVING A
VIOLATION TICKET WITH A FINE. The fine will not be less than $25.00 and not more than
$300.00 per violation,per day. Each day's failure not to comply with this ordinance or any other
order shall constitute a separate violation. If you have any questions, please feel free to call the
