1) Prior to the start of construction a Certified Soil Evaluator or Certified Professional Soil Scientist
must complete a test pit and submit written documentation of the soil types, soil textures, the
estimated seasonal high groundwater elevation, the extent of any restrictive soils in the area of the
proposed basin, and confirm the expected infiltration rate and design function of the infiltration basin
based on this information.
2. Prior to issuance of a building permit or any site work, tree protection for the trees shown to be
saved shall be installed and inspected by the City.
3. If the 9 additional parking spaces are constructed on the north of the lot as shown on the plan, the
applicant shall install the evergreen hedge as described and shown at a minimum of 3’ in height upon
planting.
4.The light on the pole on the north side of the property shall be disabled.
FINDINGS:
The Planning Board granted the site plan for the creation of more than six parking spaces (21 total) in the URC district based upon the
following information submitted with the application materials:
1. Site Plans Michael’s House Apartments by VHB.Com, May 6, 2016 Sheets C-1 to C-4.
2. Updated Plans C-2, C-3, C-4 dated September 22, 2016
3. Survey Plans Michael’s House by Heritage Surveys, Inc. April 5, 2016.
4. Lighting Plan (LT-2) Michael’s House Apartments.
In granting the Site plan with conditions, the Board determined that the Site Plan criteria in section 11.6 had been met:
A. The requested use protects adjoining premises against seriously detrimental uses. The uses will remain the same with no increase in
the number of housing units. The applicant has addressed surface water drainage, sound and sight buffers and preservation of views,
light, and air through vegetation, design of a train garden and a bituminous berm that will prevent on street flow from coming on site.
B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent
streets. The existing driveway will be utilize to access parking. The spaces will be used primarily by :
(1) With the addition of 21 parking spaces, the site contains less than one space per residential unit.
(2) The project, including any concurrent road improvements, will not decrease the level of service (LOS) of all area City and state roads
or intersections affected by the project no expansion of the current use is proposed.
C. The site will function harmoniously in relation to other structures and open spaces to the natural landscape, existing buildings and
other community assets in the area as it relates to landscaping, drainage, sight lines, building orientation, massing, egress, and
setbacks. Additional landscaping will be located between the nine parking spaces on the north side of the parcel and the abutting

property owners at the time these spaces are installed.
D. The requested use will not overload, and will mitigate adverse impacts on, the City's resources, including the effect on the City's water
supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools.
E. Compliance with the following technical performance standards:
(1) Curb cuts onto streets shall be minimized. An existing service access will be used.
(2) Pedestrian, bicycle and vehicular traffic movement on site must be separated, to the extent possible, and sidewalks must be provided
between businesses within a development and from public sidewalks
