DECISION OF
ZONING BOARD OF APPEALS
At a meeting held on December 18, 1985, the Zoning Board of Appeals
of the City of Northampton voted unanimously to deny the Variance request
of Louis Golling, 103 State Street, Northampton,for the purpose of converting
a three-family dwelling into a four-family dwelling at 103 State Street,
Northampton (URC Zone). Present and voting were: Acting Chairman William
Brandt, Kathleen M. Sheehan and Shirley Puchalski.
The findings were as follows:
IPI S. Puchalski found that a hardship exists because of Mr. Golling's
age, lifestyle and health and because of the financial investment;
that although she recognizes that the house is assessed as a four-family
-- and contains four electric meters, after a site visit, found that the
structure is a multifamily dwelling on a substandard lot; that eight
cars in the driveway on a first-in/last-out basis and backing out onto
State Street would contribute to a heavy traffic situation; and that
the hardship cannot outweigh the provisions as set forth in the Zoning
Ordinance and in Massachusetts General Laws.
K. Sheehan concurred, finding that Mr. Golling presented a hardship
and was unaware of the need for a permit; that although she recognizes
there are four electric meters and an additional kitchen facility,
there is not room for adequate parking, and it would be necessary
for a number of cars to back out onto a very busy street and inter-
section; and that the granting of this Variance would be detrimental
to the area and the public good and would derogate from the intent
II of the Ordinance.
W. Brandt also recognized Mr. Gosling's hardships in time and money
invested, however, found that the house and lot of land are substandard,
with less than one quarter of the area required (22,000 sq. ft.);
that there is an existing hazardous situation on State Street; and
that the Board cannot restrict ownership with a Variance.

DECISION OF
ZONING BOARD OF APPEALS
At a meeting held on March 31, 1986, the Zoning Board of Appeals
of the City of Northampton voted unanimously to rule that the Finding
request of Louis and Jeffrey Golling, 103 State Street, Northampton
for the purpose of altering the living arrangements in a pre-existing
nonconforming four-family dwelling located at the above address is
unnecessary and the Building Inspector may issue a building permit if
all matters pertaining to the construction meet the applicable building
codes. Present and voting were: Acting Chairman Peter Laband, Kathleen
Sheehan and Shirley Puchalski.
The findings were as follows:
P. Laband stated that after a site visit to the inside of the
premises and after conferring with the Building Inspector, he
reviewed Section 9.3 of the Zoning Ordinance and determined that
a request for a Finding or a Variance is not applicable, as the
structure does contain four units and has been taxed as a four-
family dwelling for some time. He noted that Mr. Golling is merely
requesting to internally rearrange the fourth unit, which would be
within the purview of the Building Inspector.
