(17) Construction in Fill. Where an individual sewage disposal system is to be
constructed wholly or partially in fill, the fill shall be properly placed and
compacted to minimize settlement or it shall be allowed to settle for a minimum
of 12 months whichever occurs first. The fill material shall be clean coarse
washed sand or other clean granular material essentially free from clay, fines,
dust, organic matter, large stones, masonry, stumps, frozen clumps of earth,
wood, tree branches, and waste construction material, and shall have a percola-
tion rate of less than 2 minutes per inch before and after placement. Before
the fill is put in place, all trees, brush, and stumps shall be removed from the
area to be filled. Topsoil, peat, and other impervious materials shall be
removed from all trees beneath the leaching facility and for a distance of 25
feet in all directions therefrom when the leasing facility is above natural
ground elevation; or impervious materials shall be removed for 10 feet in all
directions therefrom when the leaching facility is below natural ground eleva-
tion. No sewage disposal system shall be constructed in fill placed upon imper-
vious material unless the requirements of 310 CMR 15.03(6) have been met.
