Dear Mr. McErlain:
I am writing this letter on behalf of Mr. Charles Woodford,
of Page Blvd. Springfield, MA, to request a local variance to
install a proposed subsurface sewage disposal system within 100'
of a small wetland area and within 75' of an existing curtain
drain.
The existing wetland area is located on an adjacent lot
owned by Mr. Woodford's brother-in-law, Erwin Tessier (see plan) .
The existing wading pool on Mr. Tessier's lot was constructed as
a swimming pool for the Tessier children in the early 1950's.
The Northampton Conservation Commission ruled on July 25, 1994,
that this wading pool is not subject to protection under the
Massachusetts Wetlands Protection Act.
Over the years, a small wetland area has developed at the
outlet end of the wading pool and the Northamton Conservation
Commission has determined that only this area is subject to
regulation by the Northampton Conservation Commission.
On May 26, 1994, I conducted a percolation test and two deep
observation holes to determine site suitability for an individual
subsurface sewage disposal system at 521 Audobon Road in Leeds,
MA (site). All tests were conducted in accordance with the State
Sanitary Code Title - 5 and witnessed by the Northatpton Board of
Health agent. In my opinion, the area tested meets the
requirements of Title - 5 and is suitable for the installation of
an individual subsurface sewage disposal system.
The proposed system as designed, meets all of the setback
requirements of the State Sanitary Code Title - 5 without the
need of a State variance. A perc rate of 3 minutes per inch was
obtained on May 26, 1994. The proposed system is "over designed"
with a perc rate of 6 minutes per inch. Please refer to the
attached plan for # 521 Audobon Road in Northampton, MA.
Please note that the proposed sewage disposal system is
properly designed and meets all of the requirements of the State
Sanitary Code (ie: 25' from a curtain drain) as well as meets all
of the setback requirements of the Wetland Protection Act
Regulations (le: 50' from a wetland). Also, I expect that this
disposal system will meet the expected changes to the State
Sanitary Code Title - 5 which are likely to take effect in 1995.
It is my opinion that the daily wastewater will be
adequately treated in the substratum and that the same degree of
environmental protection will be achieved if a local variance is
granted. Due to the slopping topography of the site and the
proposed distances from the wetland and curtain drain, one could
reasonably expect the leachate to flow away from these areas and
thereby not cause undesirable degradation to the surrounding
environment. In addition, the eight interests of the wetlands
protection act will be protected if your Board allows the
Woodfords (Tessier family) to construct a subsurface sewage
disposal system at this site.
As a precaution, erosion control devices such as a silt
fence and haybales will be installed prior to construction to
eliminate the potential of silt laden runoff from entering the
protected areas

As you are aware, on September 22, 1994, the Northampton Board of Health held a
public hearing to review your request for a variance that would allow you to
construct a sewage disposal system within seventy-five (75) feet of a subsurface
drain on your property at 521 Audubon Road. The Board voted to issue the
requested varinace. The sewage leaching system will be allowed to be constructed
at a distance of seventy (70 ) feet from the drain per the submitted design plans.
The sewage construction permit will be issued upon submission of the well water
potability test report and payment of the fifty ($50) dollar permit fee.
