I To: Zoning Board of Appeals As recommended by the Northampton Planning Board at their February 10th meeting, I would like to amend my application of January 24, 1983 to include a request for a Variance from the minimum lot size requirement of 12,000 square feet for a two-family dwelling. I will briefly address the required findings which have to be met as follows: A. The variance is in regard to a particular parcel of land and the existing building on the land. B. When I bought the property in August of 1980 I was unaware of the minimum lot size requirement and was not even considering the conversion of my house into a two-family dwelling. Unfortunately, I had nothing to do with the sale of the piece of the property in the 1970's to Meadowbrook Apartments for their entrance,since I was not the owner at that time. Note should be made that it would appear that the sale of the land was quite necessary for adequate passage of incoming and outgoing traffic. Also, the amount of square footage that is missing from the minimum requirement is quite small in size, being only 831 square feet and right on the corner of the property. C. In a year's time my income will be drastically reduced because I plan to leave my job and return to graduate school. The idea for a two-family dwelling came about when I tried to think about how I could possibly meet my mortgage payments in the future.. The enforcement of the ordnance would create a substantial hardship on me. D. A two-family home will not have a detrimental effect upon the neighborhood, since my home is surrounded mostly by Meadowbrook Apartments. In addition, the house may look somewhat smaller than it is,from the outside. Inside it is quite roomy and is quite adequate in size for a two-family dwelling. anice^ . Present and voting were Chairman Robert C. Buscher , Peter Sharac and Marianne Zurn . Based on evidence presented to the Board, the Board made the following findings in regard to the variance: 1 . It was found that the parcel lacks the proper square footage because a triangular piece had been cut from the original lot in order to provide entry to the Meadowbrook Apartment Complex, thus making the parcel different from others in the district. 2 . That a literal enforcement of the Zoning Ordi- nance would involve substantial hardship to the petitioner since sale of the property as a single family home would be difficult because of its proximity to the Meadowbrook Apartment Complex area. 3 . That a two family home in proximity to the Meadowbrook Apartment Complex would not derogate from the intent of the Zoning Ordinance. Based on evidence presented to the Board, the Board made the following findings in regard to the special permit: 1 . It was found that the use is listed in the Table of Use Regulations and that it bears a positive relationship to the public convenience or welfare in that an additional dwelling unit would be added to Northampton housing stock . 2 . That one small unit would not noticeably add to the traffic nor impair pedestrian safety. 3 . Public systems would not be overloaded and that since Meadowbrook Apartments are located adja- cent to the parcel there would be no impairment of the character of the neighborhood by such a grant . The variance and special permit are granted subject to the following conditions : 1 . that both apartments met all the requirements of the City and State Building Codes ; and
