Dear John & Margaret:
We have received the decision from the Zoning Board of Appeals today;
granting your application. There is now a twenty (20) day appeal period
you must await. After the appeal period is up, you must go to the City
Clerk' s office and get a stamped copy from them which will indicate that
there has. been no appeals on the decision you received from the Zoning
Board. Then bring the stamped copy they give you over to the Registry
of Deeds and file it with them, but be sure they give you a copy to give
to us to keep on file in our office. Then you can come to our office to
apply for the building permit, but until all the above listed steps are
complete our office can 't issue you the building permit. Be sure to get
the above mentioned copy from the Registry of Deeds, so we can process
the building permit immediately.
For Your Information : Zoning Ordinance Section 10.6 - Permit Time
Limits. A Zoning Board Decision granted under the provisions of Section
10. 10 shall lapse within eighteen ( 18) months (including such time re-
quired to pursue or await the determination of an appeal ) from the grant
thereof has not sooner commenced except for good cause, or if, in the case
of a permit for construction, construction has not begun by such date
except for good cause.

At a meeting held on August 19, 1987, _a ard of
Appeals of the City of Northampton voted unanimously to grant
the Vaa a request of John K. Bollard and Margaret G. Lloyd
for the purpose of constructing an addition onto their dwelling
located at 17 Lilly Street, (Florence) Northampton, MA, which
would create a nonconforming side setback. Present and voting
were: Chairman Robert C. Buscher, Irene David and Sanford
Weil, Jr.
The findings are as follows:

connection to the house, however, due to an inadvertent error
on the plan submitted to the Building Inspector which showed a i
15 ' side setback, a building permit was issued and cement i
footings for the proposed addition are already in place. He
found that a hardship is created, as the footings are in place;
that because of the location of the dwelling on the lot it is
not structurally feasible to build an addition elsewhere
because of roof drainage problems and violation of rear
j setback; and that there will be no negative impact on the
neighborhood. He expressed hopes that the Zoning Ordinance {
I11 would be amended so that this type of situation does not
1' require a Variance, but rather a Special Permit or Finding. y
I. David stated that after a site inspection, she concurs
with the applicants that this configuration and design is the
best solution, as an addition onto the back of the house would
1' create roof drainage problems, violate rear setbacks, and not
blend in with the architectural design of the house. She found
that the footings were placed in good faith and a hardship
would be created if the applicants had to remove them; and that
the addition will enhance the appearance of the neighborhood. i

R. Buscher stated that this situation is one where two
individuals with an expanding family wish to add to their
�. living space, and were it not for the fact that the proposed
addition connects to the garage, the addition itself would be
conforming; however, because the garage is situated 10. 6 ' from j
the side lot line, the connected addition results in the entire
Idwelling to become nonconforming and requires a Variance. He
I noted that the situation is further complicated and
unfortunate, as the applicants were never informed that they
would be in violation of the Zoning Ordinance because their
architect failed to understand the Ordinance and because the
builder submitted an apparent misstatement on the application

the garage to meet the side lot requirements or the option of
building the addition and leaving a crawl space between the
