must be turned off or we will impose penalties as allowed by Section 4.9 of the zoning

Dear Eric,
After speaking to you about the lighting at 34 North Maple Street last week, I visited the
property again last night. The lighting presently installed does NOT comply with the requirements
of the City of Northampton zoning ordinance section 12.2 (Lighting). The High Intensity
Discharge fixtures used on the exterior are not shielded, resulting in significant amounts of
objectionable direct glare and light trespass (see below).

Light pollution is often,caused by the way light is ernitted from lighting equipment. Choosing proper
equipment and carefully rniauntmg and aitning it can make a significant difference,
It is entirely possible to provide security lighting without creating objectionable direct
glare and significant light trespass. There are numerous solutions available, including shielded
fixtures, add-on shields and cut-off shades.

We have received more complaints from neighbors regarding the exterior lighting
at 34 North Maple Street. We have not yet received an exterior lighting plan for that
building. The plan was due October 23, 2006. Section 12.2 of the City of Northampton
zoning ordinance has recently been amended and there many new regulations
governing exterior lighting. Bringing the lighting at 34 North Maple Street into compliance
may not be a simple proposition. We requested a lighting plan in order to review
compliance. Please submit the plan as soon as possible.

Dear Eric,
We received a complaint from a neighbor regarding the exterior lighting at 34
North Maple Street. I visited that property last night and there are a number of fixtures
that do not comply with the zoning ordinances, Section 12.2 (Lighting). Some of these
lights must be turned off immediately unless you can show that doing so would
compromise the security of people and property. This letter shall serve as Notice of
Violation and Order to comply with the City of Northampton Zoning Ordinance.
You also need to submit an exterior lighting plan for your building. The plan must
show exactly how the existing and proposed-lighting will satisfy the specific requirements
of Section 12.2. As your property abuts a residential zone, it is particularly important that
you abide by these regulations. We must receive the plan by October 23, 2006. The
lighting must be made compliant by November 22, 2006.

Hi Louis,
I will have the electricians look at the lights asap. When this was last addressed, it was determined that there was no real light
trespass, but the lights were obviously visible from the neighboring yards.
We had substantial vandalism over the year when the previous lights were not working (or lighting the area well enough.)
I will also address the parking bumpers.
