A. The request,for mixed commercial/residential use,protects adjoining premises against seriously detrimental uses because the
proposed project is to completely renovate and improve an existing mixed residential/commercial building,so that the use of the
property as a mixed-use(commercial/residential)will not change. The proposed uses are in keeping with the existing neighborhood,as
they maintain the current configuration of ground floor retail with one ground floor residential unit.
B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent
streets,minimize traffic impacts on the streets and roads in the area because the proposed change will not affect traffic impacts or
volumes over the existing uses. The proposed layout and design provides the least disruption to traffic flow on North Maple Street and,
at the same time,offers safe access for deliveries, tenant trash disposal and pick-up. Handicap access to the first floor will be
provided.
C. The requested use will promote a harmonious relationship of structures and open space to the natural landscape,existing buildings
and other community assets in the area because the proposed project will be in keeping with other buildings in the immediate vicinity
and the exterior appearance of the building will be improved thereby maintaining the historical presence of a retail component on the
street.
D. The requested use will not overload,and will mitigate adverse impacts on the City's resources including the effect on the City's water
supply and distribution system,sanitary and storm sewage collection and treatment systems,fire protection,streets and schools
because the number of units will be reduced from the current 23 to 20. Further,the building will be brought up to current code thereby
improving the quality of the existing SRO units.
E. The request use meets all special regulations set forth in Sections 5.2&10 of the Zoning Ordinance based on plans and conditions
attached to this permit because the continued use of the first floor for one residential unit will not detract from the vibrancy of the street
The reconfiguration of the retail space&alteration of the facade will increase the potential viability of the commercial core.
F. The requested use bears a positive relationship to the public convenience or welfare by providing improved retail space that will
enhance the viability for the Florence center retail market.
The use will not unduly impair the integrity of character of the district or adjoining zones,nor be detrimental to the health,morals or
general welfare because the project will improve the overall character of the existing neighborhood.
The use will be in harmony with the general purpose and intent of the Ordinance because the Board found that the mix of uses with some
ground floor residential space is primarily commercial both visually(from Main Street)and functionally and the project will add to the
vibrancy of downtown Florence.
G. The requested use will promote City planning objectives to the extent possible and will not adversely effect those objectives,as
defined in City master and Florence Center Plan by encouraging a more active and positive street life to the downtown Florence area.
The Florence Center Plan,an element of the City's Comprehensive Plan,specifically calls for.
A. Encourage mixed use so long as residential does not displace commercial level.[This project maintains the current residential/retail
mix on the first floor]
B. Maintaining full range of housing opportunities.
C. Funding for improvements to existing SRO's where appropriate,particularly to reduce adverse impacts of such units.
In addition,in reviewing the Site Plan submitted with the application, the Planning Board found that the application complied with the
following technical performance standards:
1. There will be no new curb cuts.
2.Pedestrian,vehicular and bicycle traffic are separated on-site to the extent possible.
The Planning Board voted 7:0 to Grant the waivers as requested in the application.

Dear Commissioner Patillo,
I am looking for an authoritative answer to a question regarding the West
Building. Prior to our exchange the other day, I believed that Carolyn Mish of the
Planning Department was the authority that I sought. If you are not the authority on this
question, would you please suggest whom I might ask?
My question is about use. Currently, West's has rooms. After the renovations,
the rooms will have kitchens and bathrooms. Ms. Mish has said there is no change in use
because it is still residential. Attorney St. James argued that the definition of a room is
different from a dwelling unit and therefore, is a change in use. Would you please help
me to resolve this issue?
