Request to amend original permit by eliminating conditions #2 and #5 of that permit.
HARDSHIP:
CONDITION OF APPROVAL:
1)All conditions of the original permit stand except for Condition 2 (removal of a section of bitumionous
driveway serving the abutter's property to the west).
FINDINGS:
The Board partially granted the request for amendment to the original permit based upon information submitted with the application and
testimony at the hearing.
The Board determined that eliminating the original condition #2 that required removal of a portion of the driveway serving the abutter,
that was encroaching onto the subject parcel, would not have a detrimental affect on the overall site. The Board also stated that the
condition would not affect the Board's original decision to approve the site plan for the additional structure, agreeing that the overall
project would continue to meet the site plan criteria as specified in Chapter 350 11.6. The Board acknowledged the dispute between the
two property owners and determined that the condition could only exacerbate the condition.
The Board did not approve the elimination of condition 5 which requires a fence section to be installed on the souteast corner of the
property beyond the parking area.
