I. The design and room sizes of the apartment must conform to all applicable standards
in the Health, Building, and other codes.
J. Zoning Permits issued under this section shall specify that the owner must occupy
one of the dwelling units. The Zoning Permit and the notarized letters required in K
and L below must be recorded in the Hampshire County Registry of Deeds or Land
Court, as appropriate,in the chain of title to the property,with documentation of the
recording provided to the Building Commissioner, prior to the occupancy of the
accessory apartment.
K. When a structure which has received a Permit for an accessory apartment is sold,the
new owner(s),if they wish to continue to exercise the Permit,must,within thirty(30)
days of the sale, submit a notarized letter to the Building Commissioner stating that
they will occupy one of the dwelling units on the premises as their primary residence.
This statement shall be listed as condition on any Permits which are issued under
this Section.
L. Prior to issuance of a permit,the owner(s)mu send a notarized letter stating that the
owner will occupy one of the dwelling nits on the premises as the owner's
permanent/primary residence, except for ona fide temporary absences.
M. Prior to issuance of a permit,a floor p of one-quarter(1/4)inch to the foot must be
submitted showing the building,in uding proposed interior and exterior changes to
the building.

_ Section 10.11 Residential Incentive Development Overlay District. The purpose of Residential
Incentive Development Overlay District is to provide housing opportunities that are affordable for
low and moderate-income persons. Within the overlay district, the Planning Board may issue a
Special Permit to allow housing development at somewhat greater densities than are normally
permitted by the zoning ordinance, provided:
1. A minimum of thirty-three(33)percent of the total units in the development are affordable
units.
2. The development conforms to the Table of Use and Table of Dimensional and Density
Regulations and, in all other respects, conforms to all regulations and requirements for a
Open Space (Cluster)Residential Development(§10.5)in URB districts.

Section 10.12 Home Occupation Special Permit Criteria. All Home Occupations(as defined in
§2.1) and Special Permits issued for Home Occupations shall comply with the following:

HOME OWNER EXEMPTION ACKNOWLEDGEMENT
The State of Massachusetts allows the homeowner the right under 780CMR 108.3.4 to
act as his/her construction sup��--:.sor. The state defines "Homeowner" as, " Person(s)
who owns a parcel on which he/she resides or intends to be, a one or two family
dwelling, attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a
home owner."
The building department for the City of Northampton wants any person(s) who seek to
use the home owner exemption, to act as their own construction supervisor, to be aware
that by doing so you become responsible for compliance with state building codes
and regulations. The inspection process requires that the building department be called
to inspect work at various stages, which include foundation/footings (before backfill),
sonotube holes (before pour), a rough building inspection (before work is
concealed), insulation inspection (if required) and a final building inspection. The
building department requires these inspections before the work is concealed, failure to
secure these inspections can result in failure to obtain a certificate of occupancy
until the work can be inspected.
If the homeowner hires other trades to perform work (electrical, plumbing&gas) the
homeowner will be responsible to make sure that the trades hired secure their proper
permits in conjunction to the building permit issued, and that they get their required
inspections. Failure of the individual trades to secure the permits and inspections as
required can DELAY the project until such time as the proper permits and inspections are
made

1. The roof peak of the addition may not be higher than the roof peak of the section of the existing
FINDINGS: structure adjoining this addition.
2. All second story windows along the northwest side of the addition(the wall that abuts the non-
, conforming side property boundary) shall be"awning type"and the window sills shall be at least 5.5
feet above the floor level of the second floor.
The designated Zoning Administrator granted the Finding based on the materials and graphics submitted with the application.
The Findings of the Board Administrator under Section 9.3 for an expansion of a pre-existing non-conforming side yard setback were as
follows:
1. The Administrator found that the expansion would not be substantially more detrimental to the neighborhood than the existing
nonconforming structure because the roof of the addition would be the same height as the existing portion of the structure to which the
addition will be attached and that the proposed second story windows,as offered by the applicant and conditioned herein, would be
located higher along the wall to restrict views onto the abutting property.
2. The Administator found that the addition would not extend any closer to any front,side,or rear property boundary than the current
zoning allows and that the existing structure already extends. The current non-conforming structure sits approximately 1'from the side
property boundary and the addition will be located approximately 1'from the property boundary.
3. The Administrator also determined that this extension would not create any new violation of other zoning provisions;and does not
involve a sign.
