ZONING BOARD OF APPEALS OF THE CITY OF NORTHAMPTON By: Y� Chairman Secretary Northampton Zoning Board of Appeals April 18, 1990 Meeting Page One The Northampton Zoning Board of appeals met at 7:30 p. m. on Wednesday, April 18, 1990 in Wallace J. Puchalski Municipal . Building, 212 Main Street, Northampton, to conduct a Public Hearing on the Application of Jan Stenson for a Special Permit under the Provisions of Section 11.11 of the Northampton Zoning Ordinance to allow her to conduct a home occupation, namely easel artist and restoration of paintings, in the garage of her home at 111 Oak Street, Florence. Present and voting were Chairman Robert C. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr. Ch. Buscher opened the Public Hearing by reading the Legal Notice, the Application, and a memorandum from the Northampton Planning Board. Miss Stenson explained, "I want to run a painting studio and do painting conservation work. It's a very small business, and involves me and a less than 20 hours a week helper. There are no signs, no advertising, not many visitors. I don't make any noise. Dr. Laband led her through the Section 11. 11 criteria, and found that her studio would be occupying 16% of the total floor area, no sign, hours 9-5 Monday through Friday, but not precluding her working alone evenings. Two or three deliveries of materials a month would be the maximum. Dr. Laband stated, "You've met all the criteria. " Building Inspector Palmer informed the Board that all the Fire Department standards are met, there will be only one electric meter for the entire premises, and she planned to install a sink and toilet. There being no one else present wishing to speak, Dr. Laband moved the Public Hearing be closed. Mr. Weil seconded, and the motion passed unanimously. Dr. Laband stated, "I 'm prepared to vote for this. All the Section 11. 11 criteria are met. The hours will be 9-5 Monday-Friday with deliveries allowed during those hours. The permit is to be renewed after one year. He moved to approve, Mr. Weil seconded, adding "I concur, " and Ch. Buscher added his concurrence. The motion passed unanimously. Sanford Weil, Jr. APR 2 5 1-70 j DECISION OF D NORTHAMPTON ZONING BOARD OF APPEALS ppR 2 5 INS � U11.01NG 1060 DE NOR HAMpSON MA At a meeting held on April 18, 1990, the Zoning Board of Appeals of the City of Northampton voted unanimously to GRANT the Application of Jan Stenson for a Special Permit under the Provisions of Section 11.11 of the Northampton Zoning Ordinance to allow a home occupation, namely easel artist and restoration of paintings in the garage of her home at 111 Oak Street, Florence. Present and voting were Chairman Robert C. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr. The Findings are as follows: The requested use is listed in the Table of Use Regulations as requiring a Special Permit in this district. The requested use bears a positive relationship to the public convenience and welfare in that it provides a needed service. The requested use will not create undue traffic congestion, nor will it unduly impair pedestrian safety. The requested use will not overload any municipal systems. The requested use will not impair the integrity or character of the district or adjoining zones, and is in harmony with the general purpose and intent of the ordinance. As to the criteria of Section 11. 11 of the Northampton Zoning Ordinance: The use is incidental and secondary to the use of the property for residential purposes. The use is conducted by the principal practitioner who occupies the main building as her bonafide residence, with no more than one other person engaged in the occupation. The use occupies only 16% of the gross combined floor space of the main building and accessory structure. The hours of operation are 9 a. m. to 5 p. m. , Monday through Friday. This condition does not prohibit the applicant from working alone outside those hours. Deliveries are allowed during the above-cited business hours only.
