8) How work complies with Special Permit Criteria.
1. Based on my discussions with the Building Inspector' s
office, I am applying for this Special Permit.
2. I believe the establishment of this business will be of
benefit to the community. The start of a new business will
benefit the community by providing employment and pay the
appropriate taxes . Should the business prove successful , an
expansion may be necessary that will require that the
business be moved out of my home and additional employees be
hired.
3. The business will not create any additional traffic
congestion. Since all shipments will be done by the
manufacturer located out-of-state and all business mail will
be sent to a Post Office Box, no additional traffic will
result. In addition, since I will only be processing orders
and will not be providing a retail store of any kind, there
will be no auto or pedestrian traffic caused by the
establishment of the business.
For your information, I have attached a plan of my property.
Should there still be concern about possible traffic
congestion, you can see that the entrance to my property is
not on Bridge Road. My property is entered by a driveway
located on Grandview St. Since I am the first driveway on
Grandview St. , no traffic would need to go further on the
street.
4. My business will require no municipal systems such as
public water, drainage or sewer.
5. I will fulfill all regulations regarding issuance of the
Special Permit.
6. The requested use will not unduly affect the district.
There will be no signs, no building additions, no changes to
either the exterior or interior of the building or land
other than installation of an additional phone line.

7) Narrative Description of Proposed Work. I will be operating
a small Mail Order business out of my home. This business will
be structured as follows:
- I will be the only employee of the business.
- The product sold will be stuffed animals. The animals are
manufactured out-of-state. Consequently, there will be no
manufacturing or production of any kind done in Northampton.
- I will be acting in a selling capacity only. Operating
out of my home , I will place advertising in a variety of
different magazines .
- People interested in purchasing one of my products will be
able to respond via a toll-free number. Orders will be
taken by phone and payment made by credit card or check. It
is possible that a small number of orders will be taken by
mail . I will be using a Post Office Box to handle all my
business related mail .
- Upon receipt of an order, I will fill out the appropriate
shipping labels and information. These will be forwarded to
the product manufacturer who will ship directly to the
purchaser.
- Anyone wishing to return a purchase will be issued a
return authorization by me. They will return the product
directly to the manufacturer.
- The only work done at my home will be taking orders and
doing the necessary paperwork.

Pursuant to the Provisions of the General Laws of the Commonwealth
of Massachusetts, Chapter 40A, Section 15, notice is hereby given
that a decision of the Zoning Board of Appeals of the City of
Northampton was filed in the Office of the City Clerk on the above
date AMENDING the Special Permit granted on January 4, 1989.
If you wish to appeal this action, your appeal must be filed in

The Northampton Zoning Board of Appeals met on Wednesday, August
1, 1990 at 9:20 p. m. in Council Chambers, Wallace J. Puchalski
Municipal Building, Northampton, to conduct a Public Hearing on the
Application of James R. Osofsky for a Special Permit under the
Provisions of Section 11. 11 of the Northampton Zoning Ordinance to
operate a telephone sales office at his home at 296 Bridge Road,
Northampton. Present and voting were Chairman Robert C. Buscher,
Robert Reckman, and M. Sanford Weil, Jr.
Ch. Buscher opened the Public Hearing by reading the Application,
the Legal Notice, and a memorandum from the Northampton Planning
Board. Mr. Osofsky told the board that he is in the business of
selling stuffed animals. He will place national advertising, with
an 11800" telephone number. Customers will call in their credit
card orders to his office. He will send all customer addresses to
the factory where the animals are manufactured, and shipments will
be direct from the factory to the customer. (Returns will go
direct from the customer to the factory) . No goods will be
received at 296 Bridge Road. He has a post office box off-site.
He needs the Special Permit not only to comply with the ordinance,
but to get his DBA, Visa account and 11800" telephone service.
There was no one else present to speak in favor or in opposition,
so Mr. Weil moved the Public Hearing be closed. Mr. Reckman
seconded, and the motion passed unanimously. Mr. Reckman moved the
Special Permit be granted, with the conditions listed under Section
7 of Mr. Osofsky's Application, and it be renewed in one year. Mr.
Weil seconded, and the motion passed unanimously.
Also present, in addition to those mentioned, was R. J. Pascucci,
Board Secretary.

The Northampton Zoning Board of Appeals met at 8: 00 P. M. on
Wednesday, June 19, 1991 in Council Chambers, Wallace J. Puchalski
Municipal Building, Northampton, to conduct a Public Hearing on the
Application of James R. Osofsky for renewal of the Home Occupation
Special Permit issued to him by this Board on August 1, 1990.
Present and voting were Chairman Robert C. Buscher, Dr. Peter
Laband, and M. Sanford Weil, Jr.
Ch. Buscher opened the Public Hearing by reading the Application,
the Legal Notice, and a memorandum from the Northampton Planning
Board. Mr. Osofsky said, "I have nothing to add to what's in the
application. " There were no proponents or opponents present. Ch.
Buscher noted that the Building Inspector had received no
complaints during the last ten months. Dr. Laband moved that the
Public Hearing be closed. Mr. Weil seconded, and the motion passed
unanimously.
Dr. Laband moved that the Special Permit be renewed. Mr. Weil
seconded, and the motion passed unanimously.
Also present, in addition to those mentioned, was R. J. Pascucci,
Board Secretary.

NORTHAMPTON ZONING BOARD OF AP
At a meeting held on June 19, 1991, the Zoning Board of
Appeals of the City of Northampton voted unanimously to GRANT
the request of James R. Osofsky for renewal of a Special Permit
under the Provisions of Section 11. 11 of the Northampton Zoning
Ordinance to allow a Home Occupation at his residence at 296'
Bridge Road. The original permit was granted on August 1,
1991. Present and voting were Chairman Robert C. Buscher, Dr.
Peter Laband, and M. Sanford Weil, Jr.
The findings are as follows:
1. §11. 11 provides, "All Special Permits for Home Occupations
must be renewed once, immediately following the first year of
operation. " The purpose of this provision is to allow abutters
to lodge complaints about the home occupation activity, and for
the Zoning Board of Appeals to consider rescission of the
Special Permit, if justified.
2 . The Building Inspector reports that he has received no
complaints about Mr. Osofsky's home occupation activity since
the Special Permit was granted.
3 . The Special Permit is renewed. It need not be renewed
again.
