Mario Mazza, City Councillor in this area for ten years, testified, having
been on this property many times prior to 1984, that there was no mobile home on the
premises and claimed Mr. Anciporch's affidavit was false.
Responding to inquiries from K. Sheehan, Angie Fydenkevez stated that she
noted the date of 9/20/84 because the mobile home was being moved onto the premises
on that date and she recorded the event.
Mr. and Mrs. Kaiser, 558 Bridge Road, stated that they moved to their present
residence in 1972 and often walked their dog in that area, stressing that there was
no mobile home and no one living on the premises. Mr. Kaiser stated that he saw the
trailer in the fall of 1984 and saw digging for a septic system.
John Fydenkevez stated that there is no sewer or City water in that location.
Dan Snape stated that he was a worker for Mr. Fydenkevez during 1982-83 on the
pig farm and did not see a mobile home or anyone living on the premises during that time.
Bill Kessler, 66 Market Street, also a worker for Mr. Fydenkevez during 1980-83,
stated that he saw no trailer at any time on the premises.
Responding to inquiries from the Board, Att. Zurn stated that Mr. Anciporch has
owned the property since 1938, but has an address of 104 Damon Road and commutes to
Florida in the winter.
Mr. Brooks suggested that it would help the Board ascertain the time of events
by investigating the septic system permit.
P. Laband stated that on the evidence presented, it appears that an incontrovertible
violation has occured. He suggested that P. McErlain, Health Agent, be advised of
this situation to investigate the existence of a legal septic system.
It was moved, seconded and voted unanimously to find the following:
That pursuant to the provisions as set forth in Chapter 40A, Section 14, M.G.L. ,
and Section10.9 (5) of the Northampton Zoning Ordinance, a violation of the
Northampton Zoning Ordinance does exist. The Zoning Board of Appeals heard
evidence indicating that a mobile home has been placed on the property of one
Frank Anciporch, in the rear of 604 Bridge Road, Northampton, as recently as in
the fall of 1984, and Mr. Anciporch, having been notified and failing to appear
at the public hearing on this date, did not contradict any of the testimony
presented.
Therefore, the Zoning Board of Appeals of the City of Northampton instructs the
Zoning Enforcement Officer to serve a Notice of Violation in accordance with
the provisions of Section 10.7 of the Northampton Zoning Ordinance upon Frank
Anciporch, effective from the date of filing in the City Clerk's Office.
It was moved, seconded and voted unanimously to close the meeting. Present,

The Zoning Board of Appeals of the City of Northampton held a public hearing
at 8:40 p.m. on May 14, 1986 in Council Chambers, Wallace J. Puchalski Municipal
Building to hear the appeal of a decision by the Zoning Enforcement Officer, who
allegedly failed to enforce a condition in violation of the Northampton Zoning Ordinance
at property located at the rear of 604 Bridge Road, Northampton. Present were:
Chairman Robert C. Buscher, Kathleen Sheehan and Peter Laband.
The Chairman read a memo from L. Smith, Planner, dated 12/4/85, on behalf of
the Northampton Planning Board, stating that no recommendation is forwarded because
of the complexity of the case. He advised those present of their right to appeal.
Att. Marianne Zurn, representing the Fydenkevet's, distributed a packet of
exhibits labeled #1 - 5 and explained that the petitioners originally filed their
appeal last September and were scheduled for a hearing in December, however, at
the request of the attorney for Mr. Frank Anciporch, the individual who is allegedly
in violation of the Zoning Ordinance, the Fydenkevez' s requested a time waiver to
reschedule the hearing until spring so that Mr. Anciporch could attend. Att. Zurn
noted that neither Mr. Anciporch nor his respresentative were present.
Att. Zurn Stated that this property is not visible from nor has frontage on
Bridge Road andliocated off of a road not travelled by the general populus; the
status of conditions and maintenance of this roadway is presently in Superior
Court, as Mr. Anciporch claims it is a county road and the Fydenkevez's claim it is
an easement with limitations. Att. Zurn also stated that there are a number of
various complaints her clients have filed against Mr. Anciporch, including a camper
on the premises suspected of being used as a residence, an illegal auto repair business .

a building permit; however, their central complaint, and the one that they are
requesting the Board to address, is the presence of a mobile home on the premises
situated on a permanent foundation and suspected of being used as the residence of

increased use of the roadway, which, prior to 9/20/84 was used only minimally in
connection with farming and grain storage during regular business hours and is now
used by at least four people using the road for their residences. She also stated that
there is no permit on record for a septic system and noted the status of the other
claims against Mr. Anciporch.

Dear Mr. Anciporch:
At the request of City Building Inspector Ted Tewhill, an inspection of your
property at the rear of 604 Bridge Road (map 17B, lot 2) was made on August 15,
1985 by a representative of the Northampton Board of Health. That inspection
revealed that a camper body which lacks running water and a connection to an
approved sewage disposal system is being used as a dwelling.
This condition violates 105, CMR 410.00, Chapter II of the State Sanitary Code,
Section 410.010 and renders the camper unfit for human habitation.
Under authority of Chapter III, Section 3 and 127A of the Massachusetts General
Laws, you are hereby ordered to have the camper vacated within twenty-four (24)
hours of the receipt of this notice and to cease the use of that camper as a
dwelling.

Dear Mr. Anciporch:
An inspection of your property at the rear of 604 Bridge Road (map 17B, lot 2)

including cement block, ceramic floor tile and asbestos ceiling tile had been
dumped in two separate areas. One area to the right of the auto repair shed

sanitary landfill is a violation of Section 150A of Chapter III of the Massachu-
setts General Laws and is also a public health nuisance.

materials in an approved landfill within seven (7) days of the receipt of this

The reason for this being that in, 1 believe, 1981-82 the Quonset hut,
which had been originally placed on cement blocks, partially collapsed,
taking part of the garage roof with it as well. When we repaid
hut, placing it this time on a wooden frame and reinforcing the re

wood planks as well, we also repaired the roof to the garage. The only other
changes that we have made on the garage was to put doors on the front in
order to close it in against the elements when repairing my vehicles. If

In regards to this situation, it has already been correoted. Mr. Manning
who was residing in said camper is now residing with my son in the moble
home located at the same address. The camper, however, is remaining on the
property as that in itself is of no violation of the ordinances.
2. Automobile Repair Business, Junk Vehicles and Junk Parts
a. Violation City Zoning Ordinance
Article V. Section 5.1, Page 5-1
In regards to this accusation, there never has been or will by an automobile
repair bustaese on my property. The so called business id in fact only a
repair shop for my families and my own vehicles, and as far as 1 know it is
not a violation of any ordinance to work on your own vehicles on your own
property, especially farm equipment on a farm. es for the question of Junk
vehicles and parts, 1 have made arrangements to have those which are no longer
of any value as parts vehicles for my farm equipment to be removed. This
will entail probably one or two vehicles which will be left, and they will be
removed as well when 1 have finished with them. I am sure that this will be
with in your standards, as they will be for farm equipment use.
3. Deposited Several Hundred Cubic Yards of Fill without Permit

In regards to this situation my son has spoken to you and Mr. Peter McErlain,
of the Board of Health on several occassions concerning the clean up operatidn
being performed by Mr. Fournier and ourselves. 1 believe that this situation

this letter, then very shortly after. As far as the dumping of illegal
substances, as we have already told you, we were unaware of such, as Mr. Fournier
quaranteed that there would be none, which is why we are trying to cooperate
fully with you to get the problem solved.

This is a notice of appeal of the decision of the
Zoning Enforcement Officer concerning complaints made
to the Zoning Enforcement Officer by my clients,
John and Angela Fydenkevez, by complaint dated
August 14, 1985 concerning several matters affecting
the above-described property.
Specifically, my clients appeal the decision of the
Zoning Enforcement Officer that the mobile home in
question is not in violation of Northampton zoning
laws. In addition, my clients appeal the decision
that the addition of a three-car garage to a Quonset
but located on the property was not in violation of
Northampton zoning laws.
Furthermore, this appeal is hereby taken on the opinion
of the Zoning Enforcement Officer that the violations
cited by the Zoning Enforcement Officer have been
corrected by the owner of the above-mentioned property.

In regards to this accusation, there never has been or will by an automobile
repair bustaess on my property. The so called business it in fact only a
repair shop for my families and my own vehicles, and as far as 1 know it is
not a violation of any ordinance to work on your own vehicles on your own
property, especially farm equipment on a farm. As for the question of Junk
vehicles and parts, 1 have made arrangements to have those which are no longer
of any value as parts vehicles for my farm equipment to be removed. This
will entail probably one or two vehicles which will be left, and they will be
removed as weil when 1 have finished with them. I am sure that this will be
with in your standards, as they will be for farm equipment use.

In regards to this situation my son has spoken to you and Mr. Peter McErlain,
of the Board of Health on several occassions concerning the clean up operati&n
being performed by Mr. Fournier and ourselves. 1. believe that this situation
will be eradicated to your standards completely if not by the time you receive
this letter, then very shortly after. As far as the dumping of illegal
substances, as we have already told you, we were unaware of such, as Mr. Fournier
guaranteed that there would be none, which is why we are trying to cooperate
fully with you to get the problem solved.

On August 14, 1985, we received a formal complaint that there are violations of Chapter
44, City of Northampton Zoning Ordinance; on your property at the rear of 604 Bridge Road
(Map 17B - Lot #2).
An inspection of the property was made on August 15, 1985, by the Building Inspections
Department, and the following violations were noted:

Appeal (specifying the grounds thereof) within thirty (30) days of receipt of this order.
If at the expiration of time allowed, these violations have not been remedied, further
action as the law requires shall be taken.

Mario Mazza, City Councillor in this area for ten years, testified, having
been on this property many times prior to 1984, that there was no mobile home on the
premises and claimed Mr. Anciporch's affidavit was false.
Responding to inquiries from K. Sheehan, Angie Fydenkevez stated that she
noted the date of 9/20/84 because the mobile home was being moved onto the premises
on that date and she recorded the event.
Mr. and Mrs. Kaiser, 558 Bridge Road, stated that they moved to their present
residence in 1972 and often walked their dog in that area, stressing that there was
no mobile home and no one living on the premises. Mr. Kaiser stated that he saw the
trailer in the fall of 1984 and saw digging for a septic system.
John Fydenkevez stated that there is no sewer or City water in that location.
Dan Snape stated that he was a worker for Mr. Fydenkevez during 1982-83 on the
pig farm and did not see a mobile home or anyone living on the premises during that time.
Bill Kessler, 66 Market Street, also a worker for Mr. Fydenkevez during 1980-83,
stated that he saw no trailer at any time on the premises.
Responding to inquiries from the Board, Att. Zurn stated that Mr. Anciporch has
owned the property since 1938, but has an address of 104 Damon Road and commutes to
Florida in the winter.
Mr. Brooks suggested that it would help the Board ascertain the time of events
by investigating the septic system permit.
P. Laband stated that on the evidence presented, it appears that an incontrovertible
violation has occured. He suggested that P. McErlain, Health Agent, be advised of
this situation to investigate the existence of a legal septic system.
It was moved, seconded and voted unanimously to find the following:
That pursuant to the provisions as set forth in Chapter 40A, Section 14, M.G.L. ,
and Section10.9 (5) of the Northampton Zoning Ordinance, a violation of the
Northampton Zoning Ordinance does exist. The Zoning Board of Appeals heard
evidence indicating that a mobile home has been placed on the property of one
Frank Anciporch, in the rear of 604 Bridge Road, Northampton, as recently as in
the fall of 1984, and Mr. Anciporch, having been notified and failing to appear
at the public hearing on this date, did not contradict any of the testimony
presented.
Therefore, the Zoning Board of Appeals' of the City of Northampton instructs the
Zoning Enforcement Officer to serve a Notice of Violation in accordance with
the provisions of Section 10.7 of the Northampton Zoning Ordinance upon Frank
Anciporch, effective from the date of filing in the City Clerk's Office.
It was moved, seconded and voted unanimously to close the meeting. Present,
in addition to those mentioned, were J. Parker, Board Secretary and several interested
citizens.

The Zoning Board of Appeals of the City of Northampton held a public hearing
at 8:40 p.m. on May 14, 1986 in Council Chambers, Wallace J. Puchalski Municipal
Building to hear the appeal of a decision by the Zoning Enforcement Officer, who
allegedly failed to enforce a condition in violation of the Northampton Zoning Ordinance
at property located at the rear of 604 Bridge Road, Northampton. Present were:
Chairman Robert C. Buscher, Kathleen Sheehan and Peter Laband.
The Chairman read a memo from L. Smith, Planner, dated 12/4/85, on behalf of
the Northampton Planning Board, stating that no recommendation is forwarded because
of the complexity of the case. He advised those present of their right to appeal.
Att. Marianne Zurn, representing the Fydenkevet' s, distributed a packet of
exhibits labeled #1 - 5 and explained that the petitioners originally filed their
appeal last September and were scheduled for a hearing in December, however, at
the request of the attorney for Mr. Frank Anciporch, the individual who is allegedly
in violation of the Zoning Ordinance, the Fydenkevez' s requested a time waiver to
reschedule the hearing until spring so that Mr. Anciporch could attend. Att. Zurn
noted that neither Mr. Anciporch nor his respresentative were present.
Att. Zurn stated that this property is not visible from nor has frontage on
Bridge Road andllocated off of a road not travelled by the general populus; the
status of conditions and maintenance of this roadway is presently in Superior
Court, as Mr. Anciporch claims it is a county road and the Fydenkevez's claim it is
an easement with limitations. Att. Zurn also stated that there are a number of
various complaints her clients have filed against Mr. Anciporch, including a camper
on the premises suspected of being used as a residence, an illegal auto repair business
bringing in fill without a permit and the construction of a three-car garage without
a building permit; however, their central complaint, and the one that theyremises
requesting the Board to address, is the presence of a mobile home on the p
situated on a permanent foundation and suspected of being used as the residence of
Mr. Anciporch, a Mr. Lazier and a girlfriend since September 20, 1984. She stated
that there werefive complaints forwarded to the Building Inspector (with a formal
complaint sent on August 14, 1985) , who answered all in a letter dated August 20, 1985
(exhibit #3) ; the Building Inspector' s opinion being that there was a violation of
Section 5. 1 of the Northampton Zoning Ordinance, but satisfied with Mr. Anciporch's

T. Tewhill, Building Inspector, concurred with the chronology of events and
presented photographs to the Board taken on the property in question and stated
that he acted on good faith when judging the situation. He stressed that he had no
reason to disbelieve- Mr. Anciporch. Responding to inquiries from the Chairman,ersonal Mr.
Tewhill stated that he had never visited the site previously and had no personal
knowledge of the situation prior to the* complaints, and that then had been no permi
issued for any activities on the premises".

Dear Mr. Anciporch: mobile home, rear of 604 Bridge Rd.
At the request of City Building Inspector, Ted Tewhill an inspection of your
property at the rear of 604 Bridge Road (Map 17B, Lot 2) was made on November
26, 1984 by a representative of the Northampton Board of Health. The in-
spection revealed that a mobile home has been installed on the left side of
the driveway and is apparently being occupied as a dwelling. Such a use would
violate the following regulations: 310 CMR 15.00, Title 5 of the State Envir-
onmental Code and 105 CMR 410.00, Chapter IT of the State Sanitary Code because
the Board of Health has no record of an approved sewage disposal system ever
being installed and/or connected to that mobile home.
In addition, the installation and use of a mobile home without Zoning/Building
Inspector approval violates other City and State regulations.
Under authority of 310 CMR 15.00 and 105 CMR 41.0.00, you are hereby ordered to
immediately cease the occupancy of the mobile home as a dwelling until:
1. you have obtained approval from the City Zoning/Building Inspector
for the installation and occupancy of the mobile home, and
2. you have obtained a sewage disposal works construction permit* from
the Board of Health and have installed an approved septic system.
If you have any questions concerning this matter, please contact the Northampton
Board of Health office.

Now comes Angela Mary Fydenkevez, and under oath, deposes and
says as follows:
1. I live at 604 Bridge Road, Northampton, Massachusetts. To
the best of my knowledge, the property abutting the property on
which I live, which is owned by my parents, is currently owned by
Frank Anciporch.
2. Despite an order of the Zoning Board of Appeals and an order
of the District Court of Hampshire County, Mr. Anciporch
continues to allow persons to reside illegally on that property.
3 . I have observed Steven Laizer and Teresa Marchinowski on a
regular basis drive to the back property in one set of clothes
and leave from the property many hours later in different sets of
clothes.
4. I have observed Steven Laizer, repeatedly, leave from the
property between 10: 00 and 11: 00 p.m. to go to his shift as a
Northampton police officer and return in the morning when his
shift is over.
5. I have observed Steven Laizer and apparent friends jog from
the premises in the near of where I live to areas surrounding the
premises and then jog back to the premises in question.
6. I have observed people moving furniture to the premises in
the rear.
7. I know that a trailer/mobile home is located on the rear
premises and I believe that trailer is being illegally used by
the said Steven Laizer and Teresa Marchinowski and potentially
others.
8. I have observed Robert Manning, whom I believe to be employed
by Frank Anciporch, drive a pickup truck with a camper on the
back up and down the driveway leading to the rear premises. I
believe that he, too, lives in said camper which he parks on the
rear premises.
