Responding to inquiries from K. Sheehan, Angie Fydenkevez stated that she noted the date of 9/20/84 because the mobile home was being moved onto the premises on that date and she recorded the event. Mr. and Mrs. Kaiser, 558 Bridge Road, stated that they moved to their present residence in 1972 and often walked their dog in that area, stressing that there was no mobile home and no one living on the premises. Mr. Kaiser stated that he saw the trailer in the fall of 1984 and saw digging for a septic system. John Fydenkevez stated that there is no sewer or City water in that location. Dan Snape stated that he was a worker for Mr. Fydenkevez during 1982-83 on the pig farm and did not see a mobile home or anyone living on the premises during that time. Bill Kessler, 66 Market Street, also a worker for Mr. Fydenkevez during 1980-83, stated that he saw no trailer at any time on the premises. Responding to inquiries from the Board, Att. Zurn stated that Mr. Anciporch has owned the property since 1938, but has an address of 104 Damon Road and commutes to Florida in the winter. Mr. Brooks suggested that it would help the Board ascertain the time of events by investigating the septic system permit. P. Laband stated that on the evidence presented, it appears that an incontrovertible violation has occured. He suggested that P. McErlain, Health Agent, be advised of this situation to investigate the existence of a legal septic system. The fact being that said garage was moved along with the Quonset Hut from Damon Rd. in,I believe, 1973 when both were moved to make way for the now called River Run Apt.. As for the undercarriage of the roof on the garage being new, that is correct. The reason for this being that in, 1 believe, 1981-82 the Quonset hut, which had been originally placed on cement blocks, partially collapsed, taking part of the garage roof with it as well. When we repaid hut, placing it this time on a wooden frame and reinforcing the re ophwith quona*t wood planks as well, we also repaired the roof to the garage. The only other changes that we have made on the garage was to put doors on the front in order to close it in against the elements when repairing my vehicles. Responding to inquiries from K. Sheehan, Angie Fydenkevez stated that she noted the date of 9/20/84 because the mobile home was being moved onto the premises on that date and she recorded the event. Mr. and Mrs. Kaiser, 558 Bridge Road, stated that they moved to their present residence in 1972 and often walked their dog in that area, stressing that there was no mobile home and no one living on the premises. Mr. Kaiser stated that he saw the trailer in the fall of 1984 and saw digging for a septic system. John Fydenkevez stated that there is no sewer or City water in that location. Dan Snape stated that he was a worker for Mr. Fydenkevez during 1982-83 on the pig farm and did not see a mobile home or anyone living on the premises during that time. Bill Kessler, 66 Market Street, also a worker for Mr. Fydenkevez during 1980-83, stated that he saw no trailer at any time on the premises. Responding to inquiries from the Board, Att. Zurn stated that Mr. Anciporch has owned the property since 1938, but has an address of 104 Damon Road and commutes to Florida in the winter. Mr. Brooks suggested that it would help the Board ascertain the time of events by investigating the septic system permit. P. Laband stated that on the evidence presented, it appears that an incontrovertible violation has occured. He suggested that P. McErlain, Health Agent, be advised of this situation to investigate the existence of a legal septic system. It was moved, seconded and voted unanimously to find the following: That pursuant to the provisions as set forth in Chapter 40A, Section 14, M.G.L. , and Section10.9 (5) of the Northampton Zoning Ordinance, a violation of the Northampton Zoning Ordinance does exist. The Zoning Board of Appeals heard evidence indicating that a mobile home has been placed on the property of one Frank Anciporch, in the rear of 604 Bridge Road, Northampton, as recently as in the fall of 1984, and Mr. Anciporch, having been notified and failing to appear at the public hearing on this date, did not contradict any of the testimony presented. Therefore, the Zoning Board of Appeals' of the City of Northampton instructs the Zoning Enforcement Officer to serve a Notice of Violation in accordance with the provisions of Section 10.7 of the Northampton Zoning Ordinance upon Frank Anciporch, effective from the date of filing in the City Clerk's Office. Puchalski Municipal Building to hear the appeal of a decision by the Zoning Enforcement Officer, who allegedly failed to enforce a condition in violation of the Northampton Zoning Ordinance at property located at the rear of 604 Bridge Road, Northampton. Present were: Chairman Robert C. Buscher, Kathleen Sheehan and Peter Laband. The Chairman read a memo from L. Smith, Planner, dated 12/4/85, on behalf of the Northampton Planning Board, stating that no recommendation is forwarded because of the complexity of the case. He advised those present of their right to appeal. Att. Marianne Zurn, representing the Fydenkevet' s, distributed a packet of exhibits labeled #1 - 5 and explained that the petitioners originally filed their appeal last September and were scheduled for a hearing in December, however, at the request of the attorney for Mr. Frank Anciporch, the individual who is allegedly in violation of the Zoning Ordinance, the Fydenkevez' s requested a time waiver to reschedule the hearing until spring so that Mr. Anciporch could attend. Att. Zurn noted that neither Mr. Anciporch nor his respresentative were present. Att. Zurn stated that this property is not visible from nor has frontage on Bridge Road andllocated off of a road not travelled by the general populus; the status of conditions and maintenance of this roadway is presently in Superior Court, as Mr. Anciporch claims it is a county road and the Fydenkevez's claim it is an easement with limitations. Att. Zurn also stated that there are a number of various complaints her clients have filed against Mr. Anciporch, including a camper on the premises suspected of being used as a residence, an illegal auto repair business bringing in fill without a permit and the construction of a three-car garage without a building permit; however, their central complaint, and the one that theyremises requesting the Board to address, is the presence of a mobile home on the p situated on a permanent foundation and suspected of being used as the residence of Mr. Anciporch, a Mr. Lazier and a girlfriend since September 20, 1984. She stated that there werefive complaints forwarded to the Building Inspector (with a formal complaint sent on August 14, 1985) , who answered all in a letter dated August 20, 1985 (exhibit #3) ; the Building Inspector' s opinion being that there was a violation of Section 5. 1 of the Northampton Zoning Ordinance, but satisfied with Mr. Anciporch's sworn affidavit in response to a Cease and Desist Order that the mobile home has been on the property since 1940 and was, therfore, a p r Att. At the request of City Building Inspector, Ted Tewhill an inspection of your property at the rear of 604 Bridge Road (Map 17B, Lot 2) was made on November 26, 1984 by a representative of the Northampton Board of Health. The in- spection revealed that a mobile home has been installed on the left side of the driveway and is apparently being occupied as a dwelling. Such a use would violate the following regulations: 310 CMR 15.00, Title 5 of the State Envir- onmental Code and 105 CMR 410.00, Chapter IT of the State Sanitary Code because the Board of Health has no record of an approved sewage disposal system ever being installed and/or connected to that mobile home. In addition, the installation and use of a mobile home without Zoning/Building Inspector approval violates other City and State regulations. Under authority of 310 CMR 15.00 and 105 CMR 41.0.00, you are hereby ordered to immediately cease the occupancy of the mobile home as a dwelling until: 1. you have obtained approval from the City Zoning/Building Inspector for the installation and occupancy of the mobile home, and 2. you have obtained a sewage disposal works construction permit* from the Board of Health and have installed an approved septic system. I have observed Steven Laizer and Teresa Marchinowski on a regular basis drive to the back property in one set of clothes and leave from the property many hours later in different sets of clothes. 4. I have observed Steven Laizer, repeatedly, leave from the property between 10: 00 and 11: 00 p.m. to go to his shift as a Northampton police officer and return in the morning when his shift is over. 5. I have observed Steven Laizer and apparent friends jog from the premises in the near of where I live to areas surrounding the premises and then jog back to the premises in question. 6. I have observed people moving furniture to the premises in the rear. 7. I know that a trailer/mobile home is located on the rear premises and I believe that trailer is being illegally used by the said Steven Laizer and Teresa Marchinowski and potentially others. 8. I have observed Robert Manning, whom I believe to be employed by Frank Anciporch, drive a pickup truck with a camper on the back up and down the driveway leading to the rear premises.
