DECISION OF
ZONING BOARD OF APPEALS
q At a meeting held on November 19, 1986, the Zoning Board of Appeals of
the City of Northampton voted unanimously to deny the Special Permit
request of Glenn A. Guzik, 94 Cahillane Terrace, Northampton, MA, or the
purpose of conducting a part-time real estate business out of his home at

R ne Terrace, Northampton, MA. Present and voting were: Chairman
obert C. Buscher, Peter Laband and Sanford Weil, Jr.
±' The findings were as follows:

P. Laband reviewed the definition of a home occupation and expressed.
doubts that a real estate agency is associated with a home, but more as
4 separate, larger enterprise. He stated that although it was presented
that the applicant would be starting small, the object of any business
is to expand, and he agreed with the Planning Board that it would be
difficult to set performance standards or to assess controls and measures.
Referring to Section 10.10 of the Northampton Zoning Ordinance, he
found that the requested use is listed in the Table of Use Regulations;
that the requested use does not bear a positive relationship to the
public convenience, as this is a very residential district with no other
businesses in close proximity; that the requested use will create undue
traffic congestion; that the requested use will have no affect on municipal
services; that Article XI does not apply; that the requested use will
impair the integrity and character of the district and would be of detri-
ment to the general welfare and would not be in harmony with the intent
of the Ordinance.
S. Weil concurred that the requested use does not meet the requirements
of a home occupation, as defined on Page 2.7 of the Zoning Ordinance.
After a sighting, he found that the area is strictly residential and
the creation of a business in this area would be inappropriate.
R. Buscher concurred, finding the proposed activity not in the best
interest of the immediate zone.
