TOPS 9 FORM 3002P I I' DECISION OF v� NORTHAMPTON ZONING BOARD OF APPEALS �I I At a meeting held on September 17, 1986, the Zoning Board of l Appeals of the City of Northampton voted unanimously to grant the Variance and Finding requests of Timothy Saldo and Denise Miner, i 46 Walnut Street, Northampton, MA, for the purpose of converting an i �'. existing single-family dwelling into a two-family dwelling at their residence at Northampton, MA. Present and voting were: Chairman Robert C. Buscher, William Brandt and Peter Laband. The Findings were as follows: P. Laband, referring to the request for a Finding under Section 9.3 ; (E), found that the alteration from a single to a two-family dwelling will not be substantially more detrimental, as the area is extremely dense and predominantly multifamily dwellings. Referring to the request for a Variance, he found that the topography of this property is unusual, as a former right-of-way abutting the property affects this land and not the zoning district in general; that a hardship would be created if the applicants were unable to use their dwelling because of the topography; and that relief can be granted without detriment to the public good or without derogating from the intent of the ordinance. W. Brandt found, that because of the number of multifamily dwellings, the requested use would not be substantially more detrimental than the existing use. Referring to the request for a Variance, Mr. Brandt concurred that there are unique features to this property because of the right-of-way which cuts down on the amount of square footage and creates a nonconforming setback; that a literal enforcement of the ordinance does cause a financial hardship and that relief can be granted without detriment to the public good or without derogating from the intent of the ordinance. R. Buscher concurred, finding that the granting of the Finding and Variance requests will not be substantially more detrimental, noting the unique characteristics of the lot and the predominantly multifamily area in which this property is located.
