Dear Mr. Patillo:
Almost a year ago on November 1, 1999 the Northampton Board of Health cited Bruce
and Pauline Fogel, the owners of the above property with the failure to provide a second means
of egress. In March 2000 the Northampton Building Department ordered the owners to provide
two means of egress from the second floor within 24 hours. After the owners agreed to do the
work on May 2, 2000 Mark Bibeau, a licensed contractor, applied for a permit to install a fire
escape. According to Mr. Dionne the resident at 218 Bridge Street very little work has been
done on the project. No one has been to the building to do work in the past three weeks. I have
discussed my concerns with Mr. Fogel, but he has not given me a time line for completion of the
work. The Building Code gives you the authority to fine the owners of up to $1,000.00 for each
day that the violation remains uncorrected. 780 CMR 118.4. This is a long standing serious
violation of the Building Code. Therefore, I request that you start penalizing the owners by the
imposition of fines on a daily basis until the work is completed and approved by the Building
Department.
