At a meeting conducted on December 15, 1993 ' the Northampton
Zoning Board of Appeals unanimously voted 3 : 0 to the
the
request of John H. Zieminski, Inc. for a FINDING under the
provisions of Section 9.3 (a) in the Northampton Zoning
Ordinance, for an addition to a pre-existing building, between
the rear of the residence and the garage and to construct a small
platform and steps on the driveway side of the property located
at 51 Lincoln Avenue. The structure at 51 Lincoln Street is non-
conforming because it does not meet the minimum side yard setback
requirement as outlined in the Zoning Ordinance.
Zoning Board Members present and voting were: Chairman Robert C.
Buscher, Member: Dr. Peter Laband, and Associate Member: M.
Sanford Weil, Jr.
The Findings of the Zoning Board under Section 9.3 (a) for an
extension of a Pre-existing non-conforming structure were:
1. The extension will not be substantially more detrimental to
the neighborhood than the existing non-conforming structure.
The extension would not increase the non-conformity of the
structure since the side yard setbacks would not be reduced;
2 . The extension will not create a new violation of the
existing zoning requirements because the addition of a
dining room will not alter the type of use, nor add any
additional stress to any municipal system or services that'
the City provides. The Board also stated that the addition
will not alter the view from the street.
