recorded in the Hampshire County registry of Deeds or Land Court,as applicable and indexed under the name of the owner
of record or is recorded and noted on the owner's certificate of title.The fee for such recording or registering shall be paid by
the owner or applicant.It is the owner or applicant's responsibility to pick up the certified decision from the City Clerk and

The Northampton Planning Board hereby certifies that Site Plan Approval has been GRANTED and that copies of this
decision and all plans referred to in it have been filed with the Planning Board and the City Clerk.
Pursuant to Massachusetts General Laws,Chapter 40A,Section 15,notice is hereby given that this decision is filed with the
Northampton City Clerk on the date below.
If anyone wishes to appeal this action,an appeal must be filed pursuant to MGL Chapter 40A,Section 17,with the Hampshire
County Superior Court or the Northampton District Court and notice of said appeal filed with the City Clerk within twenty
days(20)of the date of that this decision was filed with the City Clerk.

D. The requested use will not overload the City's resources, including the City's water supply
and distribution system, sanitary and storm sewage collection and treatment systems, fire
protection, streets and schools.
E. The requested use meets all special regulations set forth in the Zoning Ordinance;
particularly Section 8.9(7). (See Below)
F. The requested use complies with the following technical performance standards:
1. More than one curb cut was permitted because the Planning Board deemed that
-the additional curb cut would minimize traffic and safety impacts.
2. Pedestrian, bicycle and vehicular traffic are separated on site to the extent
possible.
The following condition was imposed upon the project:
1. Landscaping must include two street trees at least 21/2 11 in caliper along the front
property line.
As required by Section 8.9(7), the Planning Board found that issuance of the permit to
allow the second curb cut would promote and improve safe and efficient traffic circulation
because it would enable the owners of the individual units to have separate driveways,
improving their access and egress to their homes.

At a meeting conducted on June 22, 2000,the Northampton Planning Board voted unanimously
6:0 to grant the request of David McCutcheon for SITE PLAN APPROVAL under the
provisions of Sections 8.9(7) and 10.11 of the Northampton Zoning Ordinance to allow more
than one driveway/curb cut for property located at 48/50 Northern Avenue, also known as
Assessor's Map 25C, Parcels 30,31 and 32.
Planning Board Members present and voting were: Chair Daniel J. Yacuzzo, Andrew J. Crystal,
Paul Diemand, Kenneth Jodrie, M. Sanford Weil, Jr., and Associate Member Alton Neal.
In Granting Site Plan Approval,the Planning Board found:
A. The requested use for a second curb cut protects adjoining premises from seriously
detrimental uses because the lot is an oversized parcel which used to be two separate lots,
so the spacing of the two curb cuts will be in keeping with the spacing of other curb cuts
in the neighborhood. The second curb cut will serve the second unit of a duplex and will
reduce the total amount of black top in the front yard.
B. The requested use will promote the convenience and safety of vehicular and pedestrian
movement within the site and minimize traffic impacts on the streets and roads in the
area. A separate curb cut for each residence will make it safer and more convenient for
the individual owners to get in and out of their driveways and enable them to back
straight out onto the street.
C. The requested use promotes a harmonious relationship with existing structures and the
existing landscape because the number of curb cuts serving the property is consistent with
the number of curb cuts per linear foot of frontage in other parts of the neighborhood.
