I did call you to give you a heads up that a letter of violation was forthcoming for the erection of a ground sign without proper permits. The information you sent in your letter was incomplete. The application that was returned to you (MP-2004-0098) dated 2/19/2004 stated that additional permits were required for use. Specifically a special permit with site plan , as per section 5.2 from the Planning Board. Written on cover page (which you neglected to include in your correspondence to me) "Directional sign needs separate permit", that permit was never applied for. Clearly stated in Planning Board's decision"the proposed sign will be directional in nature and conform to the zoning requirements"The sign you erected does not conform to the zoning requirements for a directional sign, section 7.2 —4 of Northampton Zoning General Sign Regulations states. . ." 4. The limitations as to the number of signs permitted does not apply to traffic or directional signs which are necessary for the safety and directions of residents, employees, customers and visitors, (whether in a vehicle or on foot) of the business, industry, or residence. Such signs may carry the name of the business or project provided that said name is: A. clearly secondary in nature to the primary directional function of the sign, B. no greater than 1/2 the size of the directional message. C. may not exceed a maximum size of six (6) square feet, D. may not be any higher (top of sign) than four (4) feet from the ground. E. shall be limited to one such directional sign per curb-cut. F. if lighted, it shall be illuminated internally, or by indirect method with white light only and shall be in conformance with section 12.2. (Amended 5/18/89). The sign erected exceeds the 6 square foot requirement ( 3'9" X 1"8"), it is not clearly secondary in nature to the primary function of the sign ( directional), and more than 'h of sign is not devoted to directional nature(Design , Build, Remodel, 70 Old South Street). The purpose of your call was to give me a"heads up" that you were issuing me a citation for erecting a sign without the proper building permit. I am enclosing documentation that led me to believe that we had the approval of your department and the Planning Board for this sign. I do not have a clear memory of who approved the dimensions of the sign but it is my recollection that the dimensions came from the city prior to the Planning Board's decision on March 19, 2004 because I submitted drawings and sizes to the Planning Board for approval. I am enclosing page one of the Planning Board's decision, dated March 19, 2004. I have yellow-lined the statements that led me to believe that my proposed sign was approved. In addition to this, I am enclosing copies of a requested building permit to your office, dated November 17, 2004. Contained in my cover letter to you I stated at the end of the first paragraph the following: "At the same hearing, an exterior entrance sign was approved. Attached is a copy of the approved sign." At the bottom of the second page of the building permit application, question "C" was marked "NO" because no signs currently existed. Question "D" was answered "YES" and we inserted the following: "Directional/entrance sign, approved by Planning Board (copy of sign enclosed)."
