The The applicant proposes to construct a single family dwelling
in an SC zone. Such a development requires a special permit to
insure compliance with the s pecial regulations for the SC zone
contained in article ),III of the ordinance.
The Darcel in question does not meet certain dimensional
requirements of the current zoning ordinance. 7However. ; the lot is
pre-existing and is ,protected under the grandfather nrovisions of
Chapter 40A.
It should be noted that all requirements of ilrticl_c :3 could
be reviewed carefully in developing conditions for a s�)ecial permit.
It is also noted that the activity requires a Certifica-te of
Conditions from the Conservation Commission under the provisions
of the wetlands Protection 7=ct.

OPINION OF THE PLANNING BOARD IN THE 14ATTER OF -
Richard Ingersoll ' s request for a special permit to construct
a single family d,.,rel.ling in an SC zone -
The Planning Board, at its meeting of September 28, 1977 ,
voted unanimously to forward to the IBA its opinion that the
subject application should be approved.
The Board noted that while the proposal does not meet the
minimum requirements of the zoning ordinance for the SC district,
the parcel is protected under the provisions of the zoning law
pertaining to parcels which exist prior to the date of the
adoption of the ordinance. The Board does note that being in
the SC district, the proposal should be reviewed carefully in
Tight of the provisions in Article XIII and in accordance with
the co-zirrents of the staff report .

ASSISTANT CITY SOLICITOR
On November 16, 1977, the Zoning Board of Appeals for the City of
Northampton decided to grant the petition of Richard Ingersoll for a
special permit to construct a single family home.
Based upon evidence presented to the Board, the Board made the
following findings:
1. The use requested is listed in the Table of Use Regulations as a
special permit in the district for which application is made or is so
designated elsewhere in this Ordinance. See section- 5.1 of Appendix A.
2. The requested use bears a positive relationship to the public
convenience or ..,elfare, because the City needs additional housing.
3 . The requested use will not create undue traffic congestion, or un-
duly impair pedestrian safety.
4. The requested use will not overload any public v;ater, drainage, or
sewer system or any other municipal system to such an extent that the
requested use or any developed use in the immediate area or in any other
area of the City will be unduly subjected to hazards affecting health,
safety, or the general welfare.
5. Any special regulations for the use, set forth in Article XI, are
fulfilled.
6. The requested use will not unduly impair the integrity or character
of the district or adjoining zones, nor be detrimental to the health,
morals, or welfare. The area currently has single family dwellings.
The following conditions shall apply to this special permit: The
petitioner shall refrain from creating depressions in the land which
may collect ,cater; failure to conform to this condition will be grounds
for the Building Inspector to deny the issuance of a certificate of
occupancy.
