36-285 (4) The Planning Board of the City of Northampton met on Thursday, February 11, 1988 in Council Chambers, Wallace J. Puchalski Municipal Building, Northampton, MA. Present were VCh. M. Mendelson, J. Beauregard, A. Crystal, S. Jasinski, J. Herlihy (arr. 7: 25 p. m. ) , E. J. Gare ( left 7: 25 ill) . PUBLIC HEARING: At 7 : 20 p. m. , the Public Hearing was called on the Application of Howard Kobin for a Special Permit under the Provisions of Section 6. 12, Page 6-10 of the Zoning Ordinance of the City of Northampton for the purpose of permitting vehicular egress/access to a lot line other than the front lot line, at his property located at Southview Acres, Burts Pit Road, Northampton, MA. VCh. Mendelson read the Legal Notice as published twice in the Daily Hampshire Gazette. Mr. Kobin said he wished to avoid having to cross a wetland with his driveway were he to use the front lot line as called for by the Zoning Ordinance. He sought a Special Permit to have a driveway enter his property from Burts Pit Road. Mr. Gare asked Mr. Smith if the request was proper, and Mr. Smith replied, "Yes. " No other proponents, or opponents, spoke. Coun. Brooks inquired as to the curb cut. Mr. Smith said Applicant would need a permit to make the cut, and Mr. Andrikidis, in the audience, said there would be no problem issuing a permit. VCh. Mendelson closed the Public Hearing. Mr. Gare moved we approve the request for a Special Permit. Dr. Beauregard seconded, and the Motion passed unanimously. Marion Mendelson, Vice Chairman SPECIAL PERMIT DECISION OF THE NORTHAMPTON PLANNING BOARD At their meeting held on February 11, 1988, the Planning Board of the City of Northampton voted unanimously to APPROVE the Special Permit request of HOWARD KOBIN, 50 Fairview Avenue, Northampton, MA to permit vehicular access/egress to a lot, identified as Parcel 24 of the approved "Southview Acres Definitive Subdivision Plan" , from Burts Pit Road instead of from its front lot line (Section 6.12) , as shown on the plan submitted with the Special Permit Application. Present and voting were Vice Chairman Mendelson, Dr. Beauregard, A. Crystal, S. Jasinski and E.J. Gare. The findings were as follows: 1. The requested use does require a Special Permit under the provisions of the Northampton Zoning Ordinance, 2. The requested use bears a positive relationship to the public convenience and welfare, in that it will eliminate the need for a wetland crossing, 3 . The requested use will not create undue traffic congestion, 4. The requested use will not overload any municipal systems, 5. The requested use will be in harmony with the general purpose and intent of the Zoning Ordinance. The following conditions shall apply: A. the house number for the parcel shall be requested from the DPW to be from Burts Pit Road, B. a restriction shall be placed on the deed to the subject lot prohibiting any additional vehicular access to said lot from other than the driveway approved by this Special permit, C. such deed restriction must be submitted to and approved by the Northampton Planning Board prior to its recording and prior to the issuance of any Building Permit.
