FINDINGS:
In denying the permit, the board found that the applicant failed to sufficiently address and meet several of the required Special Permit and
the required Site Plan approval criteria.
This failure includes,but is not limited to not being in conformance with the master plans goal of creating conservation development in
this area, specifically development that is sensitive to the environment. The board found that the project would have adverse impacts on
sensitive wetlands and wildlife corridors.
There appear to be other projects that could have a smaller environmental footprint(specifically with the home moved further north)that
potentially could receive a permit, but although the applicant moved a portion of the project to reduce environmental footprint, the board
found that this option was not sufficiently explored by the applicant.
The project would have other adverse impacts on city resources,as a result of its insensitivity to the environment,inconsistent with the
Site Plan and Special Permit requirements.

Disapproval of the Stormwater Management Permit Waiver Application
based upon a determination that the proposed project shall require an
approved Stormwater Management Permit as specified in the Northampton
Stormwater Management Ordinance (Chapter 22 Article 5).

FOOTING BOTTOM INSPECTION REPORT
Our inspector visited the site for visual inspection of bottom of footing.
The area inspected was dry and compacted by using a plate compactor. The bearing surface material
consisted of light brown silty sand with little gravel. Our inspector did not observe any water or organic
soil. However, moisture appears to be higher but the bearing soil appears to be compacted.

The project, including any concurrent road improvements, will not decrease the level of service(LOS)of all area roads or intersections
effected by the project below the existing conditions. A total of$2,000 will be paid to the City of Northampton in lieu of traffic mitigation
at the time a certificate of occupancy is issued.
C. The requester/use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings
and other community assets in the area. There are no changes to the character of the buildings planned.
D. The requested use will not overload, the City's resources including the effect on the City's water supply and distribution system,
sanitary and storm sewage collection and treatment systems, fire protection,streets and schools. The project will be served by private
sewer and public water.
E. The requested use meets the regulations set forth in the Zoning Ordinance in section 5.2, 6.10, 10 and 11 for flag lots and common
driveways.
F. The requested use bears a positive relationship to the public convenience or welfare. The use will not unduly impair the integrity of
character of the district or adjoining zones, nor be detrimental to the health,morals, or general welfare.
G. The requested use will promote City planning objectives to the extent possible and will not adversely effect those objectives, as
defined in City master or study plans. The site for the new house is out of all resource areas and buffer zones.
H. Compliance with the following technical performance standards:
1. One curb cut will serve the new house lot. And the existing home.
2. Pedestrian, bicycle and vehicular traffic movement on site have been separated to the extent practicable.

1; Prior to any site work, the land offered for a conservation restriction shall be recorded on the deed. in
a form acceptable to the Office of Planning and Development and the Northampton Conservafion
Commission.
2. Prior to any site work,, boundary delineation markers for of the tree clearing line, as required in
condition 3 below, shall be checked by staff to ensure they are placed according to the plans.
3. Boundary markers along the new tree line and at the corners of said line shall be placed every 50'
along. Markers shall be either granite or other markers consistent with standard requirements of the
Conservation Commission.
4. No structure shall be placed closer to the conservation restriction boundary thar,shown on the
plan. The proposed house location, may move forward or side-to-side(east-west).
5. Tree line as proposed shall not be altered without amendment to the plan.
6. As shown on the plans, the house may not exceed the footprint or size shown (maximum of 3,000
square feet).
7. Prior to issuance of a certificate of occupancy, a payment in lieu of traffic mitigation shall be made
in the amount of$2,000 to the City of Northampton.
FINDINGS
The Planning Board approved with conditions the special permit for the creation of 2 flag lots and a common driveway based upon fire
following plans submitted with the application:

The Planning Board found:
A. The requested use protects adjoining premises against seriously detrimental uses. The existing single family house lot will be divided
to create one additional single family house lot, making both flag lots. These are consistent with the development patterns in the
Suburban Residential zoning district and vicinity.
B. The requested use will riot affect the safety of vehicular and pedestrian movement on adjacent streets. The lots will be served by a
common driveway to minimize curb cuts onto Westhampton Road.
