ZONING BOARD OF APPEALS

The Zoning Board of Appeals for the City of Northampton met on June 7,
1982 and voted unanimously to grant the petition of Philip and Cheryl Jenks
for a variance from the setback requirements to construct a garage and addi-
tional living space to their home at 723 Florence Road.
Based upon the evidence presented to the Board, the Board made the follow-
ing findings in regard to the variance:
1. The property is unique because the elevation is higher than
that of neighboring parcels.
2. A literal enforcement of the Zoning Ordinance would create
a financial hardship for the petitioners because if they
were forced to buy a larger home, they would have to replace
their mortgage at double the interest rate they now pay.
3. The proposed addition will not change the property's present
use as a single family home, and therefore, the proposal will
not be detrimental to the public good nor will it violate the
intent of the Zoning Ordinance.
