59. Maintenance reports shall be submitted to the Commission after each
recommended inspection indicating status of each element of the entire system
under the HOA's maintenance purview. Inspections shall be conducted in April
and October with reports submitted to the Office of Planning &Development no
later than May 15 and November 15 each year. If reports are not submitted within
a month of these dates, the City shall have the right to utilize funds from the
HOA's stormwater account (described in#58) to perform inspections and contract
appropriate maintenance in accordance with design and function of stonnwater
systems.
60. A bank account to be jointly held by the City and the Homeowner's Association,
capitalized with $8,000 to cover emergency expenses related to stonnwater
infrastructure (not for maintenance) shall be created by the HOA. The account
must be established in a way that requires signatures from both the HOA and the
City before the HOA may withdraw for capital expenses. If the City is required to
withdraw funds for maintenance of the system, only a City signature is required.
If funds are withdrawn for capital expenses related to the stonnwater
infrastructure, the account must be replenished within 3 months by assessing the
HOA members appropriate fees to replace the amount withdrawn. Interest from
the account, in excess of the $8,000 principal plus inflation, may be withdrawn by
the HOA periodically to be used for maintenance of the stormwater systems so
long as signatures for withdrawal are obtained from the City and the HOA. The
City has the right to place leins on one or all homeowners property to maintain
elements of the HOA infrastructure.
61. Sidewalks in front of open space shall be plowed and maintained by the HOA.
62. Compensatory storage areas must be maintained permanently. This Order allows
the reduction of storage by 64 cubic feet to reduce total BVW impact.
Compensatory storage may not be reduced further than this without further review
by the Commission.
63. Any additional cutting on lots 8-14 beyond the 50% set aside in condition#52

52. Clearing on lots 8, 9, 10, 11, 12, 13, and 14 should be minimized to the extent
possible to allow only for house construction and small lawn area. A maximum
of 50% of the building envelope may be cut for lawn and house construction.
POST CONSTRUCTION SUBMITTALS:

Upon completion of the work covered by this Order, the applicant shall submit an
as-built plan, signed and stamped by a registered professional engineer or land
surveyor, together with a written request for a Certificate of Compliance.
The plan and written request shall specify any ways that the completed project
differs from the plans referenced in the Order. The as-built plan shall include, at a
minimum, and as applicable to the project: elevations of all pipe inverts and
outlets, pipe sizes, materials, and slopes; all other drainage structures; limits of
clearing, grading, and fill; all structures, pavement, and contours within 100 feet
of wetland boundaries; all alterations within the wetland resource areas; all
wetland replication areas; and all dates of fieldwork.
54. Permanent markers shall be installed along the Limit of Work Lines on lots 8, 12,
15, 18, 26, 27, 28 & 29 and spaced 25' apart. A plan showing the location of the
markers shall be submitted to the Conservation Commission prior to requesting a
Certificate of Compliance.
ONGOING CONDITIONS:
55. Maintenance of stormwater facilities, except for the public street and associated
catch basins in the street right-of-way, shall be the responsibility of the
Homeowner's Association (HOA) and shall be in accordance with the stormwater
management plan. This plan shall be recorded in the covenants submitted prior to
the preconstruction, on-site meeting. Inspections shall be by a qualified
professional. A copy of these covenants shall be submitted to the Commission.
56. The only systems outside of the purview of the HOA for maintenance is the
public street(only after petition and acceptance by the City) and its associated
catch basins. The City will maintain these facilities in accordance with the DPW
schedule for the entire city network.
57. If Cardinal Way is not accepted as a city street, the Homeowner's Association
will be responsible for street sweeping in accordance with the Maintenance Plan
submitted in this Notice of Intent with additional street sweeping to be done
monthly from April through June. Receipts for street sweeping shall be submitted
with the semi-annual reports required in condition #59.
58. All drainage swales, check dams, and rip rap basins shall be kept clear of
sediments and inspected semi-annually concurrently with maintenance schedule
specifications in the plans and this order and shall be replaced as
necessary.
5. An adequate stockpile of erosion control materials shall be on site at all
times for emergency or routine replacement. The stockpiles equipment
shall include materials to repair silt fences, haybales, or any other devices
planned for the control of erosion at.the site.
42. If soils are to be disturbed for longer than two months, a temporary cover of rye
or other grass shall be established, following Natural Resources
Conservation Service (NRCS) procedures, to prevent erosion and sedimentation.
WETLAND REPLICATION:
43. A Wetland specialist shall submit written notification to the Commission upon the
installation of the plantings.
44. A Wetland specialist shall submit written notification to the Commission the date
that the installation of the plantings is complete.
45. A wetland specialist, approved by the Conservation Commission, shall be on-site
during all phases of the transference/replanting and construction of the replication
area.
46. A report of the success of re-vegetation activities shall be submitted to the
Conservation Commission, by a qualified wetlands scientist on the following
schedule:

47. If more than 50% wetland vegetation has not been established after one growing
season (1 year), then additional plantings and/or changes to the wetland
restoration plan shall be submitted to the Conservation Commission for
consideration and approval.
48. If more than 75%wetland vegetation has not been established after two growing
seasons (2 years), then additional plantings and/or changes to wetland restoration
plan shall be submitted to the Commission for consideration and approval.
49. The streambed of Parsons Brook shall be restored to its pre-construction condition
upon setting of the utility lines.
50. All utility lines that traverse wetland resource areas should be placed within
culverts or in ductile iron sleeves to allow for maintenance without disturbing the
wetlands.
51. Landscaping that identifies the boundaries of the lots lines on lots 8, 12, 13, 18,
20, 21 & 29 must be in place prior to issuance of certificates of occupancy for .

33. Prior to issuance of building permits on lot 15 and lot 18 silt fences shall be
placed on the boundary of the building envelope as shown on the plans. Prior to
construction, the Commission or its agent must inspect this fencing.
34. The compensatory storage area shall be created prior to construction of bridge
crossing of Parsons Brook and inspected by commission or agent.
35. The detention basins 2 and 3 shall be created prior to the construction of the road
crossing Parson's Brook.
36. The applicant shall notify the Commission, in writing, as to the date that the work
will commence on the project. Said notification must be received by the
Commission no sooner than (10) days and no later than five (5) days prior to the
commencement of the approved activity;
37. The applicant shall notify the Commission in writing of the name, address,
business and home telephone numbers of the project supervisor and/or contractor
who shall be responsible for ensuring compliance with the conditions in this
Order.
38. All wetland replication shall be completed prior to the sale of the 10' (half of the
total subdivision) lot.
REQUIREMENTS DURING ACTIVE CONSTRUCTION:
39. Silt fencing and erosion control shall be in place prior to removal of stumps
within the right of way. Silt barriers chosen should be those that minimize
potential for introduction/proliferation of invasive plants and seedlings. The use
of haybales is discouraged.
40. Wetland Flags shall be checked by the designated wetlands consultant and
replaced as necessary for the duration of the construction (until a Certificate of
Compliance is granted).
EROSION CONTROL:
41. Areas of construction shall remain in a stable condition at the close of each
work/construction day:
1. Erosion controls shall be inspected at this time, and after each rainstorm.
2. Any entrapped silt shall be removed to an area outside of the buffer zone
and wetland resource areas.
3. Any breaches in the siltation barriers shall be repaired prior to leaving the
site for the day.
4. All erosion controls must be maintained or reinforced to meet
25. This order applies to the subdivision plans shown with a 22'wide paved road from
Burts Pit Road to Westhampton Road. For the section of road extending from the
edge of Lot 2 to Westhampton Road, this order is approved for either a 22' wide
roadway with 7' treebelt on both sides or a 22' wide roadway with 7' tree belt on
the east side with a 4' wide sidewalk on the west side.
26. The total wetland replication area must be revised on the final plans to show
115% replication of the approximately 11,000 square feet of buffer zone,
bordering and isolated wetland impacts which will accommodate any potential
impacts to isolated wetlands on lots 15 and 18.
27. Construction of individual residential structures within the building envelopes
shown is approved through this Order so long as the required erosion control and
siltation barriers are placed as indicated on the plans and in this Order. Therefore,
no further permitting by the Conservation Commission is required for individual
house construction unless there is any encroachment beyond the building
envelope or which is outside the scope of this order. Such expansion of scope
would require additional review by the Commission.
PRE-CONSTRUCTION REQUIREMENTS:
28. As offered by the applicant in the Notice of Intent, prior to the construction of the
road (Cardinal Way), the proposed open space shall be dedicated to the
Northampton Conservation Commission in fee simple.
29. If the applicant does not dedicate this land to the Commission, as proposed in the
Notice of Intent, the applicant must apply for an amendment of this Notice to the
Commission and DEP showing an alternative means for mitigating impacts to the
resource areas.
30. Prior to construction of the roadway, an irrevocable Letter of Credit for $65,000
must be submitted to the Office of Planning &Development for the wetland
replication work. This may be consolidated with a Letter required for the
Planning Board permit so long as there is at least $65,000 for wetland replication
work. The Letter must be for 5 years. If the Letter is for 1 year, it must renew
automatically or have a provision, which states that the City may call the Letter if
it is not renewed within 60 days prior to expiration. Language must also set forth
standard criteria for default as outlined in the City of Northampton Subdivision
Rules and Regulations. The Letter may be renewed/extended beyond 5 years by
approval of the Conservation Commission only if such a request is made three
months prior to the expiration of the Letter.
31. Prior to the sale of the first building lot the applicant must notify the Commission
so that access signs may be posted at lots 8, 12, 13, 18, 20, 21, & 29 by the
Commission for these entrances to the public trail system.
32. Prior to issuance of building permits on lots 8, 12, 13, 14, 26, 27, 28, 29 all silt
fences must be in place at the work limit line of 75' from the wetland boundary
and inspected by the Commission or its agent.

18. The owner of the property described in this Order must advise any potential buyer
of the property that any construction or alteration to said property, including brush
cutting or clearance, may require approval by the Northampton Conservation
Commission. In addition, this Order of Conditions shall be recorded individually
with lots 8, 12, 13, 14, 15, 17, 18, 19, 20, 26, 27, 28 & 29.
Any instrument conveying any or all of the owners' interest in said property or
any portion thereof, shall contain language similar to the following:
"This property is subject to the Northampton Wetlands Protection
Ordinance and/or Wetlands Protection Act. Any construction or
maintenance work performed on this property requires an Order of
Conditions, and/or a Determination of Applicability from the
Northampton Conservation Commission.
19. A copy of this Order and associated plans shall remain on site during all
construction and/or building activities. The project manager and all equipment
operators shall be familiar with the approved plans, and shall be informed of their
location on the site. This location shall be accessible to all contractors
whenever work is occurring on site.
20. All required permits must be obtained from the Army Corp of Engineers (Section
404, Water Quality Certification), Planning Board, Zoning Board, Department of
Public Works, or Building Inspector prior to the start of projects involving fill
within any wetland resource area;
21. No disposal of soils or other materials shall be allowed within: a 100-year
floodplain; 40 feet of the 100-year floodplain elevation; any wetland; or any area
within 100-feet of a wetland, unless such areas are specifically approved by the
Commission, in accordance with 310 CMR 10.00, and City of Northampton
Ordinances - Chapter 24;
22. All revised plans, referenced within this Order of Conditions, shall be approved
by the Conservation Commission and incorporated into this Order by reference
and shall be followed during the course of construction.
23. Ongoing conditions that shall not expire with the issuance of a Certificate of
Compliance are as follows: #55, 56, 57, 58, 59, 60, 61, 62 & 63.
24. Prior to the start of any site work, excavation or construction, a preconstruction
conference shall be held on the site, between the contractor conducting the work,
the site/project engineer, the applicant, and a member or agent of the
Conservation Commission, in order to ensure that the requirements of this Order
are understood by all parties. Prior to the pre-construction meeting, all erosion
control devices must be installed, also.

C. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department, with the appropriate filing
fee and a completed Appendix E: Request of Departmental Action Fee Transmittal Form, as provided in
310 CMR 10.03(7) within ten business days from the date of issuance of this Order. A copy of the request
shall at the same time be sent by certified mail or hand delivery to the Conservation Commission and to
the applicant, if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, § 40) and is inconsistent with the wetlands regulations (310 CMR 10.00).

15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a
Certificate of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.

4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until,all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to

other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
